JUSTICE MANAK MOHTA\n\n\nMr.P.N.Mohnani for the petitioner.\nMr.A.R.Nikub , Public Prosecutor.\nMr.Vineet Jain for Mr.Sandeep Mehta for respondent No.2.\n\n\n     This revision petition has been filed by the-petitioner\n\nagainst the order dated 05.10.05 passed by the learned Addl.\n\nSessions Judge No.2, Chittorgarh Camp Begu in Sessions\n\nCase No.52\/05 under section 366 and 376 IPC by which the\n\naccused has been acquitted.\n\n\n\n     With the consent of the parties, the matter was heard at\n\nthe admission stage and is being disposed of by this order.\n\n\n\n     Brief facts of the case are that, on the complaint made\n\nby the husband of the present petitioner a case       vide FIR\n\nNo.170\/05 was registered against accused respondent No.2\n\nArjun Kumar under sections 366, 376 IPC and after usual\n                                   2\n\ninvestigation case was challaned in the court and the matter\n\nwas committed to the court of Sessions Judge, where charges\n\nwere framed and           prosecution evidence started. During\n\nprosecution evidence, statement of PW\/3           Smt. Khurshida\n\n(petitioner), was recorded. She did not support the prosecution\n\nstory.\n\n\n\n         Considering her statement , learned Public Prosecutor did\n\nnot want further time to produce other evidence. The learned\n\ntrial court, after recording the statement of the accused under\n\nsection 313 Cr.P.C. and after hearing both sides, did not find\n\nthe charges against the accused          proved and thereby he\n\nacquitted the accused vide impugned judgment and            order\n\ndated 05.10.05. Against that order the present revision has\n\nbeen filed by the petitioner. Notice of this revision was issued\n\nto the respondents, record of the case was called             and\n\narguments were heard.\n\n\n\n         During the course of arguments, learned counsel for the\n\npetitioner submitted that the learned trial Judge has passed\n\nthe order in a hasty manner. He should not have closed the\n                                  3\n\nevidence and should have summoned all the other witnesses.\n\nIt was also    stated    that   during the     statement of Smt.\n\nKhurshida, (PW\/3) she was not confronted with her previous\n\nstatements recorded under 161 and 164 Cr.P.C. Thus, the trial\n\nis vitiated and the impugned order is bad in law. A request\n\nwas made      to quash     the same and the revision may be\n\nallowed. The learned counsel for the         petitioner also cited\n\njudgments given in       Shailendra Kumar vs. State of Bihar\n\n[2002 Cri.L.J. 568) and <a href=\"\/doc\/926636\/\">K.Anbazhagan vs. Superintendent\n\nof Police<\/a> [2004 Cri.L.J.583], in support of his contentions.\n\n\n\n     On the contrary , learned Public Prosecutor, as well as\n\nlearned counsel appearing on behalf of accused respondent ,\n\nrefuted the contentions     placed by learned counsel for the\n\npetitioner and supported the judgment given by the learned\n\ntrial court. It was     submitted that    the statement of Smt.\n\nKhurshida, given during trial,       which has not supported the\n\nprosecution story, has not       been      disowned even during\n\nargument. Thereafter, nothing remains to be probed and no\n\nfruitful purpose was going to be served by confronting with the\n\nearlier statements and calling of all the remaining witnesses.\n                                     4\n\nTherefore , the learned Public Prosecutor has not demanded\n\nfurther time to produce evidence and learned trial court has\n\nrightly proceeded and          acquitted the accused. There is no\n\nground for interference in judgment. The authorities cited by the\n\nlearned counsel for the petitioner do not apply to the present\n\ncase and prayed that the revision may be dismissed.\n\n\n\n     I have considered the rival submissions and perused the\n\nmaterial    available on record. I have also gone through the\n\njudgments cited by the learned counsel for the petitioner.\n\n\n\n     The charges against the accused respondent           were of\n\nsections 366 and 376 IPC. During the course of trail ,\n\nstatement    of   petitioner    PW\/3    Smt.Khurshida   has   been\n\nrecorded, in which she has not supported the allegations and\n\nfurther has stated her age to be 32 years and she is mother of\n\nthree children. In that scenario, the learned trial court proceed\n\nfurther and after recording the statement under section 313\n\nCr.P.C., acquitted the accused vide the said judgment.\n\n\n\n     During the course of       arguments, on behalf of the\n\npetitioner , her recorded statement during trial has not been\n\ndisputed. In that position, the contentions      of the learned\n\ncounsel for the petitioner that she has not been confronted\n\nwith her previous statements and other     witnesses have not\n\nbeen called, are not having any legal force. Considering the\n\nposition of the case, learned Public Prosecutor did not seek\n                                 6\n\nfurther time for producing the other witnesses and learned\n\ncourt has proceeded in accordance with law.\n\n\n\n     I have also perused the judgments cited by the learned\n\ncounsel for the petitioner in the case of Shailendra Kumar's\n\ncase (supra) it was observed that even after the order closing\n\nprosecution evidence by High Court, the trial court was\n\ncompetent for allowing the prayer for producing the witnesses .\n\nIt was a case where        charges were framed        against the\n\naccused persons for the offence punishable under sections of\n\n148, 149, 323, 449 and 302 IPC.         In that case, the evidence\n\nwas closed by the concerned trial court on the pretext that\n\ntime was not sought by the learned Public Prosecutor. Later on\n\nthat order was recalled, but the order of         recall was not\n\nmaintained by High Court.           Thereafter, application under\n\nsection 311 Cr.P.C. for producing of witnesses was filed but\n\nthat was also rejected in the light of earlier order of the High\n\nCourt. But that is not the position in the present case. Neither\n\nthe evidence was closed by the trial court, nor any grievance in\n\nthat respect was made with regard to production of evidence\n\nby the petitioner, or by State before the trial court. Likewise, in\n                                  7\n\nthe other judgment in K.Anbazhagan's case (supra) the case\n\nrelated to P.C. Act , wherein the scope of 154 Evidence Act\n\nhas been dealt with but facts of the present case are different.\n\nThus, both the the judgments do no help the contentions of the\n\npetitioner.\n\n\n\n           Thus, on the basis of aforesaid discussion, I do not\n\nconsider any illegality or irregularity in the impugned judgment\n\nand order. There is no ground for interference.
