SHAH\n\t\t\n\t\n\n \n\nDate\n: 29\/03\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioners have prayed for an appropriate writ, order<br \/>\nand\/or direction, directing the respondent No.1 to implement the<br \/>\norder dated 18\/05\/2006 passed by Deputy Collector, Dholka in<br \/>\nallotting the plots in question of land bearing Survey No.22 and to<br \/>\nmake necessary entry in the revenue record.\n<\/p>\n<p>2.\t\tIn<br \/>\npursuant to the Notice issued by this Court, Ms.Jirgha Jhaveri,<br \/>\nlearned Assistant Government Pleader has appeared on behalf of<br \/>\nDistrict Collector, Dholka and has stated at the bar under the<br \/>\ninstruction from Mr.S.K.Zala, Clerk, Dholka, that  as such vide order<br \/>\ndated 09\/06\/2008 allotment of the land in question in favour of the<br \/>\npetitioners has been cancelled as the said plots are not capable of<br \/>\nbeing allotted. She has placed on record communication dated<br \/>\n09\/06\/2008, which is directed to be taken on record. She has also<br \/>\nstated at the bar that at the relevant time, the petitioners were<br \/>\nserved with the order\/communication dated 09\/06\/2008, which is<br \/>\ndisputed by Mr.Viral Dave, learned advocate appearing on behalf of<br \/>\nthe petitioners. It is submitted by Mr.Viral Dave, learned advocate<br \/>\nappearing on behalf of the petitioners that so far as the petitioners<br \/>\nare concerned, they are not aware that allotment in favour of the<br \/>\npetitioners was cancelled and even they were not served with<br \/>\ncommunication\/order dated 09\/06\/2008.\n<\/p>\n<p>3.\t\tBe<br \/>\nthat it may. Let Ms.Jirgha Jhaveri, Learned Assistant Government<br \/>\nPleader may give copy of communication\/order dated 09\/06\/2008 to<br \/>\nMr.Viral Dave, learned advocate appearing on behalf of the<br \/>\npetitioners. If the the petitioners are aggrieved by the said<br \/>\ncommunication\/order dated 09\/06\/2008, the same can be challenged by<br \/>\nthe petitioners, which can be considered in accordance with law and<br \/>\non merits.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of with above liberty.
