Sharan, A.C. to A.A.G-II\n                                   -----------\n<\/pre>\n<p>02.   15.11.2010                 Heard learned counsel for the petitioner and<\/p>\n<p>                    learned counsel for the State.\n<\/p>\n<p>                                 The petitioner questions the order dated<\/p>\n<p>                    29.4.2005 initiating departmental proceedings against<\/p>\n<p>                    him under 43 (b) of the Bihar Pension Rules. He is<\/p>\n<p>                    stated to have superannuated on 31.10.2004.<\/p>\n<p>                                 Learned counsel for the petitioner submits<\/p>\n<p>                    that the charges relate to the period 2.5.1991 to<\/p>\n<p>                    30.11.1999, when he was posted as a Junior Engineer<\/p>\n<p>                    in the Road Construction Division, Lakhisarai. It is<\/p>\n<p>                    submitted that the memo of charge is dated 2.2.2005<\/p>\n<p>                    which is much beyond the period of four years from<\/p>\n<p>                    the date of the charge. Reliance is placed upon a<\/p>\n<p>                    decision of the Supreme Court reported in A.I.R. 1995<\/p>\n<p>                    SC 1853 (State of Bihar and Others Versus Mohd. Idris<\/p>\n<p>                    Ansari) on which a decision of this Court reported in<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>2010 (1) P.L.J.R 686 (Bhubneshwar Sharma Versus<\/p>\n<p>The State of Bihar &amp; Others) is founded.<\/p>\n<p>          Learned counsel for the respondents from<\/p>\n<p>the counter affidavit submits that the issue was<\/p>\n<p>discovered in the audit objection of the year 1999-<\/p>\n<p>2000. The petitioner did not handover charge in 1999<\/p>\n<p>and therefore it is a continuing cause of action.<\/p>\n<p>          It is the specific assertion of the writ<\/p>\n<p>petitioner in paragraph-7 that the charge period in<\/p>\n<p>question is between 2.5.1991 to 30.11.1999. In that<\/p>\n<p>context it has been pointed out during submission that<\/p>\n<p>the   period   mentioned      in    paragraph-10    is    an<\/p>\n<p>inadvertent error and should be read in consonance<\/p>\n<p>with paragraph-7 of the writ application. Dealing with<\/p>\n<p>these two paragraphs, the respondents in their counter<\/p>\n<p>affidavit have stated that it is a matter of record. It<\/p>\n<p>therefore goes beyond the pale of any controversy that<\/p>\n<p>the charges relate to the period 1991 to 1999. Even, if<\/p>\n<p>the charges are taken to commence from 30.11.1999,<\/p>\n<p>the memo of charge dated 2.2.2005 is clearly beyond<\/p>\n<p>the period of four years.\n<\/p>\n<p>          In   view   of    the    discussion   noticed   in<\/p>\n<p>paragraph-13 of the judgment of this Court in the case<\/p>\n<p>of Bhubneshwar Sharma (supra) as explained by the<\/p>\n<p>Supreme Court, the present proceedings under Section<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>       43 (b) of the Bihar Pension Rules are clearly barred as<\/p>\n<p>       being beyond the period of four years from the date of<\/p>\n<p>       charge. The entire departmental proceedings against<\/p>\n<p>       the petitioner including memo of charges are therefore<\/p>\n<p>       quashed. The petitioner is held entitled to entire<\/p>\n<p>       consequential benefits in accordance with law.<\/p>\n<p>                 The application stands allowed.\n<\/p>\n<\/p>\n<pre>P.K.
