S.J. MUKHOPADHAYA)<\/p>\n<p>This writ<br \/>\n\tpetition has been preferred by the petitioner against the physical<br \/>\n\tpossession taken by the respondent &#8211; State Bank of India,<br \/>\n\tSurat for auction sale of the residential house of the petitioner.<br \/>\n\tOne of the grounds taken is that amount of Rs.8,08,684 deposited by<br \/>\n\tthe petitioner on 31st<br \/>\n\tMarch 2010 and 4th<br \/>\n\tSeptember 2010 has not been adjusted towards the claim amount and<br \/>\n\twhile the matter for One Time Settlement is pending before the Lok<br \/>\n\tAdalat, the present action has been taken.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing on behalf of the petitioner would contend that the<br \/>\n\tpetitioner is ready to pay the outstanding dues in instalment if the<br \/>\n\tBank reaches One Time Settlement.   It appears that the Bank has<br \/>\n\talready moved before the Debt Recovery Tribunal, Ahmedabad under<br \/>\n\tSection 19 of the  Recovery of Debts Due to Banks and Financial<br \/>\n\tInstitutions Act, 1993 (&#8220;RDDB Act, 1993&#8221;, for short) and<br \/>\n\tOriginal Application<br \/>\n\tNo.112 of 2010 is pending.  In the meantime, the Bank has taken<br \/>\n\tsteps under Section 13(4) of the Securitisation and Reconstruction<br \/>\n\tof Financial Assets and Enforcement of Security Interest Act, 2002<br \/>\n\t(&#8220;SARFAESI Act&#8221;, for short).  In the circumstances,<br \/>\n\tthere being a remedy before the Debt Recovery Tribunal, we are not<br \/>\n\tinclined to interfere with the matter at this stage under Article<br \/>\n\t226 of the Constitution of India.\n<\/p>\n<p>\tThe petitioner<br \/>\n\tis given liberty to approach the Bank for One Time Settlement.  If<br \/>\n\tsuch application is made, the Bank, instead of going for auction<br \/>\n\tsale, may make settlement with the petitioner as per their scheme.<br \/>\n\tIn addition to that or in alternative, the petitioner may also move<br \/>\n\tin appeal before the Debt Recovery Tribunal under Section 17 of the<br \/>\n\tSARFAESI Act if Act or the Rules framed thereunder has been<br \/>\n\tviolated. Petitioner may also ask for interim relief from the Debt<br \/>\n\tRecovery Tribunal, which may consider the same in accordance with<br \/>\n\tlaw.  Writ petition stands disposed of with the aforesaid<br \/>\n\tobservation.  Direct Service is permitted.\n<\/p>\n<p>\t\t(S.J.
