04.   24.09.2010           Heard learned counsel for the petitioner and<\/p>\n
                   the State.\n<\/p>\n
                           The petitioner seeks bail in a case instituted<\/p>\n
                   for the offences under Sections 20 and 22 of N.D.P.S.<\/p>\n
                   Act.\n<\/p>\n
                           It has been submitted that even though the<\/p>\n
                   allegation is that 108 Kgs. ganja was recovered from a<\/p>\n
                   hutment belonging to the petitioner but the two<\/p>\n
                   seizure-list witnesses namely Panjabi Rai and Sanjeet<\/p>\n
                   Kumar examined in paragraphs 18 and 19 of the case<\/p>\n
                   diary have specifically stated they had signed on the<\/p>\n
                   seizure-list after the articles had been collected at one<\/p>\n
                   place by the informant.\n<\/p>\n
                           Considering the same as also that the<\/p>\n
                   petitioner   has   no   criminal   antecedent,   let   the<\/p>\n
                   petitioner, above named be released on bail on<\/p>\n
                   furnishing bail bond of Rs. 5,000\/- (Five Thousand)<\/p>\n
                   with two sureties of the like amount each or any<\/p>\n
                   other surety as fixed by the Court to the satisfaction
\n                    2<\/span><\/p>\n
of 1st Additional District & Sessions Judge, Vaishali<\/p>\n
at Hazipur in connection with Raghopur P.S. Case<\/p>\n
No. 7 of 2010 subject to the following conditions:- (i)<\/p>\n
That one of the bailors will be a close relative of the<\/p>\n
petitioner who will give an affidavit giving genealogy<\/p>\n
as to how he is related with the petitioner and the<\/p>\n
other bailor shall be the son\/daughter of the<\/p>\n
petitioner. The bailor will also undertake to inform<\/p>\n
the Court if there is any change in the address of the<\/p>\n
petitioner. (ii) That the affidavit shall clearly state that<\/p>\n
the petitioner is not an accused in any other case and<\/p>\n
if he is he shall not be released on bail. (iii) That the<\/p>\n
bailor shall also state on affidavit that he will inform<\/p>\n
the court concerned if the petitioner is implicated in<\/p>\n
any other case of similar nature after his release in<\/p>\n
the present case and thereafter the court below will<\/p>\n
be at liberty to initiate the proceeding for cancellation<\/p>\n
of bail on the ground of misuse. (iv) That the<\/p>\n
petitioner will be well represented on each date and if<\/p>\n
he fails to do so on two consecutive dates, his bail will<\/p>\n
be liable to be cancelled.\n<\/p>\n
         The S.P. Vaishali is directed to take action<\/p>\n
against the Investigating Officer of Raghopur P.S.
\n                              3<\/span><\/p>\n
           Case No. 7 of 2010 instituted under Sections 20 and<\/p>\n
           22 of N.D.P.S. Act since even though in the First<\/p>\n
           Information Report it was stated that the articles were<\/p>\n
           recovered from the places concerned in the presence<\/p>\n
           of the witnesses a different version is given by the said<\/p>\n
           witnesses. The seizure-list also does not contain the<\/p>\n
           signature   of   the   accused   persons.    These   are<\/p>\n
           elementary steps which have to be followed by each<\/p>\n
           Investigating Officer. Strict action shall be taken<\/p>\n
           against the Investigating Officer concerned and a<\/p>\n
           compliance report shall be sent before this Court<\/p>\n
           immediately.\n<\/p>\n
                    Put up under the heading “To be Mentioned”<\/p>\n
           after receipt of the compliance report.<\/p>\n
                    Let this order be communicated to S.P.<\/p>\n
