When the petitioner<br \/>\nwas admitted in the Primary School for the first time 35 years ago,<br \/>\nhis caste was stated to be Hindu Baria and sub-caste was indicated as<br \/>\nHindu Baria Bhil at Sr. No.203 of the General Register of Vadbhet<br \/>\nPrimary School, Taluka Devgadh Baria, District Dahod.\n<\/p>\n<p>2.2\tThe<br \/>\nSchool Leaving Certificate of the petitioner<br \/>\nalso contains the said date of birth. The District Social Welfare<br \/>\nOfficer, Panchmahal, Godhra, issued caste certificate dated 09th<br \/>\nJuly 1983 bearing No.1890 as per Annexure-A stating that the<br \/>\npetitioner<br \/>\nbelongs to Hindu Bhil Tribe, which is one of the Tribes recognized by<br \/>\nthe Government of Gujarat as Scheduled Tribes.\n<\/p>\n<p>2.3\tOn<br \/>\n22nd May 2009, the respondent No.1 issued a notice to the<br \/>\npetitioner<br \/>\nasking him to remain present before the Scrutiny Committee on 08th<br \/>\nJune 2009 for verification of the Scheduled Tribe Certificate with<br \/>\nhim. On 12th June 2009, the petitioner<br \/>\nforwarded his representation by an R.P.A.D. along with 15 documents<br \/>\nin support of his claim of belonging to Scheduled Tribe. However,<br \/>\nvide impugned order the respondent No.1 cancelled the caste<br \/>\ncertificate dated 09th July 1983 issued to the petitioner<br \/>\nrelying upon several documents. Hence, this petition.\n<\/p>\n<p>3.0\tDuring<br \/>\nthe course of hearing, Mr.K.B. Pujara, learned<br \/>\nadvocate for the petitioner,<br \/>\nhas mainly submitted that while passing the impugned order, the<br \/>\nrespondent No.1 has relied upon several documents, however, the<br \/>\npetitioner<br \/>\nhas not been provided with any of the documents relied upon by the<br \/>\nrespondent No.1 while cancelling the caste certificate of the<br \/>\npetitioner<br \/>\nand even the petitioner was not present on the date of<br \/>\ndecision.\n<\/p>\n<p>4.0\tAt<br \/>\nthis stage, Mr.J.K. Shah, learned Assistant Government Pleader, has<br \/>\nsubmitted that in view of the facts and circumstances of the case,<br \/>\nthe respondent-authority will provide copies of the documents relied<br \/>\nupon by the respondent No.1 while passing the impugned order.\n<\/p>\n<p>5.0\tIn<br \/>\nview of aforesaid, the present petition is hereby partly allowed. The<br \/>\nimpugned order dated 30th July 2009 passed by the<br \/>\nrespondent No.1 is hereby quashed and set aside. The matter is<br \/>\nremanded to the respondent No.1 for deciding the same afresh. The<br \/>\nrespondent No.1 is directed to provide all the documents relied upon<br \/>\nby the respondent No.1 in the impugned order within a period of four<br \/>\nweeks from today. The petitioner<br \/>\nthereafter will file his reply and after hearing the petitioner,<br \/>\nit will be open for the respondent No.1 to pass<br \/>\nappropriate orders in accordance with law on the merits of the<br \/>\nmatter.
