    Petitioners  are  the   father  and  widow   of<\/p>\n
deceased  Binu  Das,  who  died  under   suspicious<\/p>\n
circumstances on 1.11.2007. Crime No.361\/2007 of<\/p>\n
Kazhakuttom Police Station was registered under<\/p>\n
Section 174 of Code of Criminal Procedure on the<\/p>\n
suspicious death of Binu Das, after recording the<\/p>\n
statement of Stephen, the brother of the mother of<\/p>\n
the deceased Binu Das. Postmortem examination on<\/p>\n
the   body   was   conducted   on   2.11.2007    by<\/p>\n
Dr.K.S.Meena,  Assistant   Professor  of   Forensic<\/p>\n
Medicine. The blood and viscera, preserved at the<\/p>\n
time of autopsy, were sent for chemical analysis.<\/p>\n
Based on the investigation, Sub Inspector of Police<\/p>\n
filed a report before Sub Divisional Magistrate,<\/p>\n
Thiruvananthapuram  stating   that  there   is   no<\/p>\n
suspicion regarding the death.\n<\/p>\n

     2. Later, on 15.2.2008, report of chemical<\/p>\n
analysis, on examination of the blood and viscera,<\/p>\n
collected at the time of autopsy and examined at<\/p>\n
the   laboratory, was  received  by   Investigating<\/p>\n
Officer, which discloses that death was due to<\/p>\n
Triazophos poisoning. Based on that report, Sub<\/p>\n
Inspector    re-opened   the   investigation    and<\/p>\n
questioned the witnesses. Superintendent of Police,<\/p>\n
Thiruvananthapuram  Rural,  as   per  order   dated<\/p>\n
28.3.2008, entrusted the investigation to Deputy<\/p>\n
Superintendent of Police, Attingal. In spite of<\/p>\n
investigation,  no  progress  could  be   achieved.<\/p>\n
Petitioners, at this stage, filed this petition<\/p>\n
under Article 226 of Constitution of India for a<\/p>\n
writ of mandamus commanding respondents to transfer<\/p>\n
Crime No.361\/2007 of Kazhakuttom Police Station  to<\/p>\n
the     fifth  respondent,   Central   Bureau    of<\/p>\n
Investigation   or  to  some  other   Investigating<\/p>\n
Agency.\n<\/p>\n

     3. Deputy Superintendent of Police, Attingal,<\/p>\n
who was entrusted with the investigation, filed a<\/p>\n
statement dated 4.7.2008 stating that in spite of<\/p>\n
investigation, no conclusion could be reached how<\/p>\n
the poison triazophos reached the body of Binu Das<\/p>\n
and the case is being investigated and informants<\/p>\n
were set in and around Gandhipuram to watch public<\/p>\n
talk regarding the death and steps are being taken<\/p>\n
to find out whether the deceased purchased the<\/p>\n
alleged poison from any of the shops, prior to the<\/p>\n
incident and whether there is any enemy among his<\/p>\n
friends or relatives and to find out whether there<\/p>\n
was any money transaction with the deceased.<\/p>\n
     4. Later, as directed, the Deputy Superintendent<\/p>\n
of Police filed a further statement dated 21.7.2009<\/p>\n
stating that on investigation, it is revealed that<\/p>\n
Binu Das married the second petitioner on 7.4.2004<\/p>\n
and when she belongs to Christian community, he<\/p>\n
belongs to Nadar community and along with the wife,<\/p>\n
he had gone to Gulf and though marriage was 3=<\/p>\n

years earlier, no child was begotten and Binu Das<\/p>\n
had availed loan from Gulf to construct a house at<\/p>\n
Gandhipuram and though the house was constructed,<\/p>\n
the property stands in the name of his mother and<\/p>\n
being a diabetic patient, he had some physical<\/p>\n
illness and when Binu Das parted for the last time<\/p>\n
from his friends, he had told them as to how long<\/p>\n
they could meet again and in spite of investigation,<\/p>\n
from where the poison was purchased could not be<\/p>\n
found out and it appears that it is a case of<\/p>\n
suicide.\n<\/p>\n
     5.    A reply  affidavit  was   filed  by   the<\/p>\n
petitioners controverting to the findings and the<\/p>\n
statements, contending that there was no proper<\/p>\n
investigation and in such circumstances, necessary<\/p>\n
directions are to be issued.\n<\/p>\n
     6.Learned counsel appearing for the petitioners<\/p>\n
and learned Government Pleader were heard.<\/p>\n
     7. It cannot be disputed that death of Binu Das<\/p>\n
was under suspicious circumstances. From the report<\/p>\n

of chemical analysis, it cannot be disputed that it<\/p>\n
was not a natural death, but was due to triazophos<\/p>\n
poisoning.   Though,  in  the  subsequent statement<\/p>\n
filed by the Investigating Officer it is stated<\/p>\n
that it could be a case of suicide, if triazophos<\/p>\n
poison    was consumed  by  the  deceased with  the<\/p>\n
intention    to commit   suicide,  he  should  have<\/p>\n
purchased the same from some shop. Investigation<\/p>\n
does not reveal that the deceased obtained the<\/p>\n
poison. If poison was consumed by the deceased, the<\/p>\n
balance or the bottle, should have been available<\/p>\n
somewhere near to the place of occurrence or with<\/p>\n
the deceased. Nothing could be recovered. Though,<\/p>\n
it is stated that it could be a case of suicide, no<\/p>\n
material was unearthed to support the case of<\/p>\n
suicide. In such circumstances, in spite of the<\/p>\n
fact that Investigating Officer sought time to<\/p>\n
complete the investigation stating that certain<\/p>\n
aspects, which are specifically mentioned in the<\/p>\n
written statement, are to be found out, in spite of<\/p>\n

the   protracted  investigation, nothing  could  be<\/p>\n
unearthed.    In  such circumstances,  interest  of<\/p>\n
justice warrants that there should be a proper,<\/p>\n
effective and thorough investigation.<\/p>\n
     Writ petition is disposed directing the first<\/p>\n
respondent, Director General of Police, to handover<\/p>\n
investigation of Crime No.361\/2007 of Kazhakuttom<\/p>\n
Police     Station to the   Crime Branch,  with   a<\/p>\n
direction to conduct investigation by a competent<\/p>\n
Officer not below the rank of Deputy Superintendent<\/p>\n
of Police. It is made clear that Investigating<\/p>\n
Officer has to conduct a thorough, effective and<\/p>\n
expeditious investigation.\n<\/p>\n
