Respondent\/s<br \/>\n                 =============================================<br \/>\n                 Appearance :\n<\/p>\n<pre>                 For the Petitioner\/s    : Mr.\n                 For the Respondent\/s     : Mr.\n<\/pre>\n<p>                 =============================================<\/p>\n<p>4   21-09-2011              Although the matter has been listed under the heading<\/p>\n<p>                 &#8220;To Be Mentioned&#8221;, this Court permitted the parties to make<\/p>\n<p>                 submissions on merit.\n<\/p>\n<p>                            Heard learned counsel for the petitioner and learned APP<\/p>\n<p>                 for the State.\n<\/p>\n<p>                            This is repeat application filed on behalf of the petitioner<\/p>\n<p>                 who has been declared juvenile in conflict with law seeking bail in<\/p>\n<p>                 a case instituted under Sections 364 and 120B of Indian Penal<\/p>\n<p>                 Code. His earlier application seeking bail was rejected by this<\/p>\n<p>                 Court vide order dated 3.11.2010 (Annexure-1) with the following<\/p>\n<p>                 observation:\n<\/p>\n<blockquote><p>                            &#8220;This Court, however, grants liberty to the<br \/>\n                            petitioner to renew prayer for bail in the Court<br \/>\n                            below itself if all the prosecution witnesses are not<br \/>\n                            examined within 07 months from the date of<br \/>\n                            receipt\/production of a copy of this order in the<br \/>\n                            Court below.&#8221;<\/p><\/blockquote>\n<p>                            Status report was called for in this case. The report is at<br \/>\n Flag-A. It appears therefrom that till today, no witness on behalf of<\/p>\n<p>the prosecution has been examined. Learned counsel submits that<\/p>\n<p>another co-accused (a juvenile), who is similarly placed, during<\/p>\n<p>the pendency of this application, has been released by this Court<\/p>\n<p>by order dated 16.3.2011 (Annexure-3).<\/p>\n<p>          Considering the facts and circumstances of the case as<\/p>\n<p>also the liberty granted under order dated 3.11.2010 and in the<\/p>\n<p>light of status report, I am persuaded to direct release of the<\/p>\n<p>petitioner on bail.\n<\/p>\n<p>          Let the petitioner above named be released on bail on<\/p>\n<p>furnishing bail bonds of Rs. 10,000\/- (ten thousand ) with two<\/p>\n<p>sureties of the like amount each to the satisfaction of learned<\/p>\n<p>Juvenile Justice Board, Kaimur (Bhabua) in connection with<\/p>\n<p>Juvenile Trial No. 226\/202 of 2010\/2011 (arising out of Bhabua<\/p>\n<p>P.S. Case No. 540 of 2009 (G.R.No. 1957 of 2009) subject to the<\/p>\n<p>following conditions:\n<\/p>\n<blockquote><p>          (i)           One of the bailors shall be father\/mother of<\/p>\n<p>                        the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>          (ii)          It shall be the duty of the father\/mother of<\/p>\n<p>                        the petitioner to keep guard on him and to<\/p>\n<p>                        ensure that petitioner does not fall in the<\/p>\n<p>                        company of criminal. The bailor shall also<br \/>\n                            ensure his personal appearance at the trial<\/p>\n<p>                           when directed therefor. In case of default<\/p>\n<p>                           in such appearance, the Trial Court shall<\/p>\n<p>                           have liberty to cancel the bail bonds of the<\/p>\n<p>                           petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                 (iii)     During the subsistency of the application,<\/p>\n<p>                           if the petitioner found involved in any<\/p>\n<p>                           other criminal case, the same shall be a<\/p>\n<p>                           breach of the condition of bail entailing<\/p>\n<p>                           cancellation.<\/p><\/blockquote>\n<p>                         (Kishore K.
