{"id":104152,"date":"2009-01-06T00:00:00","date_gmt":"2009-01-05T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shri-jawahar-lal-vs-deputy-commissioner-of-police-on-6-january-2009"},"modified":"2019-02-14T00:44:43","modified_gmt":"2019-02-13T19:14:43","slug":"shri-jawahar-lal-vs-deputy-commissioner-of-police-on-6-january-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shri-jawahar-lal-vs-deputy-commissioner-of-police-on-6-january-2009","title":{"rendered":"Shri Jawahar Lal vs Deputy Commissioner Of Police &#8230; on 6 January, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Shri Jawahar Lal vs Deputy Commissioner Of Police &#8230; on 6 January, 2009<\/div>\n<pre>                  CENTRAL INFORMATION COMMISSION\n                    Appeal No CIC\/WB\/A\/2007\/01342 dated 21.11.2007\n                       Right to Information Act 2005-Section 19\n\nAppellant:        Shri Jawahar Lal\nRespondent:       Deputy Commissioner of Police (DCP),<\/pre>\n<p>                  Crime &amp; Railways, Delhi.\n<\/p>\n<p>                                      Decision<\/p>\n<p>       The Commission has received an appeal from Shri Jawahar Lal of<br \/>\nNajafgarh, New Delhi praying as follows: &#8211;\n<\/p>\n<blockquote><p>       &#8220;Neither the required informations have been supplied by the<br \/>\n       PIO\/DCP\/Crime &amp; Railways within thirty days nor the appellate<br \/>\n       authority has directed the PIO\/DCP\/Crime &amp; Railways to<br \/>\n       supply the proper informations (sic)&#8221;<\/p><\/blockquote>\n<p>     That information seeking details of action taken on three FIRs filed in PS<br \/>\nNajafgarh Delhi was asked by an application submitted to DCP (Crime &amp;<br \/>\nRailways) on 8.8.&#8217;07. On not receiving a response Shri Jawahar Lal submitted an<br \/>\nappeal on 7.9.&#8217;07 before the JCP Crme &amp; Railways. However, in the meantime in<br \/>\nhis response dated 6.9.&#8217;07 which appellant received on 11.9.&#8217;07, PIO Crime has<br \/>\nconveyed a point wise reply. But Shri Jawahar Lal has moved a 2nd appeal<br \/>\nbefore us, alleging delay in responding to his RTI application and that some<br \/>\ninformation had been concealed and some withheld. He has however, not taken<br \/>\nrecourse to a 1st appeal allowed to him u\/s 19 (1) of the RTI Act on the<br \/>\ninformation supplied in the letter dated 6.9.&#8217;07.\n<\/p>\n<p>             Because the 1st appellate authority has not addressed the questions<br \/>\nof appellant, which are of direct concern to his public authority, the Commission<br \/>\nhas decided to remand this appeal to First Appellate Authority &amp; Addl.<br \/>\nCommissioner of Police, Crime &amp; Railways, P.H.Q., Delhi to dispose of the<br \/>\nappeal of Shri Jawahar Lal within ten working days from the date of receipt<br \/>\nof this decision, under intimation to Shri Pankaj Shreyaskar, Jt Registrar,<br \/>\nCentral Information Commission.\n<\/p>\n<p><span class=\"hidden_text\">                                          1<\/span><\/p>\n<p>       The FAA should moreover satisfy himself on the issue of delay and if so<br \/>\nrequired approach this Commission for initiation of proceedings under section 20<br \/>\nof the RTI Act for imposition of penalty and\/or recommending appropriate<br \/>\ndisciplinary action.\n<\/p>\n<p>      If not satisfied with the information provided on his 1st appeal, appellant Shri<br \/>\nJawahar Lal will be free to move a 2nd appeal before us as per Sec 19 (3).\n<\/p>\n<p>      Announced.
