Justice C.K.ABDUL REHIM\n\n Dated :31\/03\/2009\n\n O R D E R\n         PIUS.C.KURIAKOSE &amp; C.K.ABDUL REHIM, JJ.\n                     ------------------------\n               LAA Nos.582\/2000 &amp; 351\/2002\n                     ------------------------\n\n            Dated this the 31st day of March, 2009\n\n                           JUDGMENT\n<\/pre>\n<p>Pius C.Kuriakose, J.\n<\/p>\n<p>     Though these cases pertain to acquisition for      different<\/p>\n<p>purposes, since the properties are similar and we find that the<\/p>\n<p>judgment which is impugned in L.A.A.582\/2000 has been relied<\/p>\n<p>on in L.A.A.351\/2002, we are inclined to dispose them of by a<\/p>\n<p>common judgment.\n<\/p>\n<p>           Having gone through the impugned judgments, we<\/p>\n<p>find that the only item of evidence, on the basis of which the<\/p>\n<p>learned Subordinate    Judge refixed the market value of the<\/p>\n<p>acquired   properties  at    Rs.2   Lakhs,   was  the  Advocate<\/p>\n<p>commissioner&#8217;s report.      The three sale documents      put in<\/p>\n<p>evidence by the claimants were of post notification documents.<\/p>\n<p>The 4th one, a pre -notification document relating to a property<\/p>\n<p>to which, as rightly submitted by the learned counsel, could not<\/p>\n<p>have been     made basis.      The   advocate commissioner has<\/p>\n<p>certainly recommended that the market value of the property at<\/p>\n<p>the relevant time was Rs.2,50,000\/-. May be, the learned senor<\/p>\n<p><span class=\"hidden_text\">LAA. No.582\/2001                2<\/span><\/p>\n<p>counsel is right in saying that having regard to the peculiar<\/p>\n<p>location of the acquired properties in these cases, a document in<\/p>\n<p>respect of a comparable property, a property which is exactly<\/p>\n<p>similar is impossible. At the same time, determination of market<\/p>\n<p>value by the land acquisition court considering the reference<\/p>\n<p>under Section 18 has to be on the para metres set out in Section<\/p>\n<p>3 of the Act 2 of 1965.\n<\/p>\n<p>      2. We have gone through the Advocate commissioner&#8217;s<\/p>\n<p>report. The commissioner gives his recommendation not on the<\/p>\n<p>basis of the value revealed in any sale documents. The report of<\/p>\n<p>the commissioner, based solely on information orally conveyed<\/p>\n<p>to him by the local people, could not have been made bases by<\/p>\n<p>the reference court for refixing the market value at the rates<\/p>\n<p>presently granted. Nevertheless, we are convinced that the basis<\/p>\n<p>document relied on by the awarding officer is not relevant for<\/p>\n<p>determining the market value of the acquired property since the<\/p>\n<p>property covered by the basis document was not at all compared<\/p>\n<p>with the acquired properties.\n<\/p>\n<p>      3. Having made a survey of the evidence including the oral<\/p>\n<p>evidence adduced by the parties, we feel that the correct market<\/p>\n<p><span class=\"hidden_text\">LAA. No.582\/2001                 3<\/span><\/p>\n<p>value of the property at the relevant time was more than Rs.1<\/p>\n<p>Lakh. At the same time, we leave the question of determining<\/p>\n<p>the correct market value on the basis of the evidence to the<\/p>\n<p>reference court itself.\n<\/p>\n<p>     The result is that the judgments under appeals are set<\/p>\n<p>aside. The land acquisition reference cases are referred to the<\/p>\n<p>land acquisition reference court. That court is directed to permit<\/p>\n<p>both sides to adduce further evidence and        to take  a fresh<\/p>\n<p>decision on the basis of the evidence which comes on record in<\/p>\n<p>2009. While passing revised judgment, the reference court will<\/p>\n<p>have due      regard to the principles laid down by the Supreme<\/p>\n<p>Court in     <a href=\"\/doc\/199712657\/\">G.M.Oil &amp; Natural Gas Corporation Ltd. v.<\/p>\n<p>Rameshbhai Jivanbhai Patel &amp; Anr.<\/a> (2008 SAR (Civil) 894 )<\/p>\n<p>and will take into account post notification document only when it<\/p>\n<p>becomes absolutely necessary. However, in view of our finding<\/p>\n<p>that the market value    at the relevant time is above Rs. 1 Lakh<\/p>\n<p>per cent, there will be a direction to the respondents to deposits<\/p>\n<p>50% of the amount payable under the decree , which is being<\/p>\n<p>set aside less amounts already deposited within two months and<\/p>\n<p>upon such deposits, the appellants will be entitled to withdraw<\/p>\n<p><span class=\"hidden_text\">LAA. No.582\/2001              4<\/span><\/p>\n<p>such amounts.\n<\/p>\n<p>      The order of remand will become operative only if the<\/p>\n<p>amounts as directed above is deposited by the appellants within<\/p>\n<p>three months from today.
