Justice C.T.RAVIKUMAR\n\n Dated :02\/12\/2009\n\n O R D E R\n           KURIAN JOSEPH &amp; C.T.RAVIKUMAR, JJ.\n             -----------------------------------------\n                   W.P(C)No.28208 of 2009\n             -----------------------------------------\n         Dated this the 2nd day of December, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>           The writ petition is filed with the following prayer:-<\/p>\n<p>              (i) issue a writ in the nature of mandamus<\/p>\n<p>        or any other appropriate writ, direction or order<\/p>\n<p>        commanding the respondents 2 to 4 to give<\/p>\n<p>        adequate and effective police protection to the<\/p>\n<p>        petitioner and his employees and also for<\/p>\n<p>        collecting   the   bus     stand   fees    and  route<\/p>\n<p>        announcement fees as per Ext.P1 and P6 at the<\/p>\n<p>        Attingal Municipal Bus stand during the financial<\/p>\n<p>        year 2009-10, from the illegal and highhanded<\/p>\n<p>        actions of respondents 7 to 12, their employees<\/p>\n<p>        and henchmen.\n<\/p>\n<p>According to the petitioner owing to resistance from respondents<\/p>\n<p>7 to 12 he is not in a position to collect the bus-stand fee as duly<\/p>\n<p>authorised by the 5th respondent Municipality. The Municipality<\/p>\n<p>supports the case of the petitioner.       It is submitted that the<\/p>\n<p>Municipality has duly authorised the petitioner as per the tender,<\/p>\n<p>to collect the fees.     Learned Senior Counsel appearing for<\/p>\n<p>W.P(C)No.28208 of 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>respondents 7 to 12 submits that collection of announcement fee<\/p>\n<p>is not an authorised levy. It is also submitted that there was no<\/p>\n<p>such condition at the time of tender. Still further it is the case of<\/p>\n<p>the party respondents that the levy was given as a special<\/p>\n<p>concession to the petitioner. In view of the vehement submission<\/p>\n<p>on the part of the learned Senior Counsel that the levy is not<\/p>\n<p>authorised as per the tender condition we called for the records<\/p>\n<p>pertaining to the tender. We find from the tender notification<\/p>\n<p>itself that the Municipality had notified not only the collection of<\/p>\n<p>bus stand fee, but the announcement fee also. We find from the<\/p>\n<p>records that the Municipality had not in fact fixed the rates. It<\/p>\n<p>was for fixation of rates, the petitioner made the representation<\/p>\n<p>before the Municipality and the Municipality only fixed the rates<\/p>\n<p>as per its decision dated 14-8-2009. We find from Ext.R7 that<\/p>\n<p>the party respondents have taken up the matter in appeal before<\/p>\n<p>the Municipal Council. Therefore, it is only appropriate that the<\/p>\n<p>party respondents pursue their proper remedy, which they have<\/p>\n<p>pursued before the Municipal Council.       However, there is no<\/p>\n<p>justification in not permitting the petitioner to collect the<\/p>\n<p>W.P(C)No.28208 of 2009<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>announcement fee as fixed by the Municipality and as duly<\/p>\n<p>authorised, until a decision is taken by the Municipality in the<\/p>\n<p>appeal\/appeals filed by the party respondents.<\/p>\n<p>      Therefore, this writ petition is disposed of directing<\/p>\n<p>respondents 1 to 4 to render necessary assistance to the<\/p>\n<p>petitioner to collect the bus stand fee and the announcement fee<\/p>\n<p>as duly authorised by respondents 5 and 6.
