Jani, learned<br \/>\n\tAdditional Public Prosecutor, waives service of Rule on behalf of<br \/>\n\tthe respondent-State.\n<\/p>\n<p>Present<br \/>\n\tapplication is filed by the applicant under Section 389 of the Code<br \/>\n\tof Criminal Procedure, 1973 for suspension of sentence imposed upon<br \/>\n\thim vide judgment and order dated 24th November 2010<br \/>\n\tpassed by the learned Principal District &amp; Sessions Judge,<br \/>\n\tGandhinagar, in Sessions Case No.42 of 2009 by releasing the<br \/>\n\tapplicant-accused on bail during the pendency of the appeal.\n<\/p>\n<p>The<br \/>\n\tlearned Principal District &amp; Sessions Judge, Gandhinagar, by his<br \/>\n\tjudgment and order dated 24th November 2010 convicted the<br \/>\n\tapplicant for the offences punishable under Section 395 of the<br \/>\n\tIndian Penal Code and ordered to undergo rigorous imprisonment for a<br \/>\n\tperiod of five years and also imposed fine of Rs.02,000\/-, and in<br \/>\n\tdefault of payment of fine, ordered to undergo simple imprisonment<br \/>\n\tfor a further period of two months.\n<\/p>\n<p>Heard<br \/>\n\tMr.Ashish Dagli, learned counsel for the applicant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced before me as well as the<br \/>\n\tjudgment and order of conviction passed by the learned Principal<br \/>\n\tDistrict &amp; Sessions Judge, Gandhinagar.\n<\/p>\n<p>Looking<br \/>\n\tto the facts of the case, I am of the opinion that this is a fit<br \/>\n\tcase to suspend the sentence awarded to the applicant. Hence, the<br \/>\n\tpresent application is hereby allowed. The substantive sentence is<br \/>\n\thereby placed under suspension pending hearing and disposal of the<br \/>\n\tmain appeal and the applicant-original accused are hereby ordered to<br \/>\n\tbe released on bail on their furnishing surety of Rs.10,000\/- and a<br \/>\n\tpersonal bond of the like amount on usual terms and conditions. Rule<br \/>\n\tis made absolute to the aforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
