Soni Yadav\n                                      Versus\n                                  STATE OF BIHAR\n                                      ------\n<\/pre>\n<p>2\/      17.09.2010               Heard learned counsel for the petitioners and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                 There is case and counter case in between the parties.<\/p>\n<p>                     Submission of the learned counsel for the petitioners is that the<\/p>\n<p>                     offence under Section 379 of the I.P.C. is ornamental. General and<\/p>\n<p>                     omnibus allegations of causing injuries of simple nature is alleged<\/p>\n<p>                     against petitioner no.1. Co-accused, Mahesh has been alleged for<\/p>\n<p>                     causing assault on head by means of lathi with no repetition.<\/p>\n<p>                                 Considering the facts and circumstances of the case,<\/p>\n<p>                     prayer of the petitioners is allowed.\n<\/p>\n<p>                                 In the event of arrest or surrender within one month<\/p>\n<p>                     from the date of receipt\/production of a copy of this order in<\/p>\n<p>                     connection with Rajoun P.S. Case No. 51 of 2010 above named<\/p>\n<p>                     petitioners shall be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                     10,000\/- (ten thousand)each with two sureties of the like amount<\/p>\n<p>                     each to the satisfaction of C.J.M., Banka subject to the conditions as<\/p>\n<p>                     laid down under Section 438(2) of Cr.
