BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                     B.A.No. 6683 of 2007\n                  - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 12th day of November, 2007\n\n                               O R D E R\n<\/pre>\n<p>     Application for anticipatory bail.               The petitioner faces<\/p>\n<p>allegations under Section 376 I.P.C. Investigation is complete.<\/p>\n<p>Final report has already been filed. Cognizance has been taken<\/p>\n<p>by the learned Magistrate. Committal order was passed. The<\/p>\n<p>Sessions Court has taken cognizance. The case is now pending<\/p>\n<p>as S.C.340 of 2005 before the Fast Track Court-I, Trichur.<\/p>\n<p>Consequent to the non-appearance of the petitioner before the<\/p>\n<p>learned Sessions Judge, a warrant of arrest has been issued<\/p>\n<p>against the petitioner. The petitioner finds such warrant of arrest<\/p>\n<p>issued by the learned Sessions Judge chasing him.<\/p>\n<p>     2. According to the petitioner he is absolutely innocent.<\/p>\n<p>His failure\/omission to appear earlier was not wilful, but was due<\/p>\n<p>to reasons beyond his control.           The parties have settled their<\/p>\n<p>disputes. The petitioner has married the victim. They had settled<\/p>\n<p>the disputes before the matrimonial court also.                  In these<\/p>\n<p>B.A.No. 6683 of 2007<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>circumstances it is prayed that the petitioner may not be vexed with<\/p>\n<p>arrest and detention in the pending case.\n<\/p>\n<p>      3. It is certainly for the petitioner to appear before the learned<\/p>\n<p>Sessions Judge and explain to the learned Judge the circumstances<\/p>\n<p>under which he could not earlier appear before the learned Judge. I<\/p>\n<p>have no reason to assume that the learned Sessions Judge would not<\/p>\n<p>consider the application for bail to be filed by the petitioner when he<\/p>\n<p>surrenders before the learned Judge, on merits, in accordance with law<\/p>\n<p>and expeditiously. Every court must do the same. No special or<\/p>\n<p>specific direction appears to be necessary. Sufficient general directions<\/p>\n<p>have already been issued by this Court in the decision in <a href=\"\/doc\/147290035\/\">Alice George<\/p>\n<p>v. Dy.S.P. of Police<\/a> (2003 (1) KLT 339).\n<\/p>\n<p>      4. This application is accordingly dismissed.      I may however<\/p>\n<p>hasten to observe that if the petitioner appears before the learned<\/p>\n<p>Sessions Judge and applies for bail after giving sufficient prior<\/p>\n<p>notice to the Prosecutor in charge of the case,       the learned Judge<\/p>\n<p>must proceed to pass orders on merits, in accordance with law and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself. I need only mention that<\/p>\n<p>B.A.No. 6683 of 2007<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>it will be open for the petitioner to place all materials before the<\/p>\n<p>learned Sessions Judge to show that the petitioner has already married<\/p>\n<p>the victim and has settled the disputes with the victim.<\/p>\n<p>                                              (R.
