Justice V.RAMKUMAR\n\n Dated :30\/03\/2007\n\n O R D E R\n                            V.RAMKUMAR, J.\n\n                             ----------------------------\n\n                     Bail Application No. 1950\/2007\n\n                            -----------------------------\n\n                  Dated this  30th day of March, 2007\n\n\n                                  O R D E R\n<\/pre>\n<p>                 The     petitioner,     who   is   the   accused   in   Crime<\/p>\n<p>No.15\/2007 of Cantonment Police Station, Thiruvananthapuram,<\/p>\n<p>for offences punishable under Sections 381, 468, 471 and   420<\/p>\n<p>IPC, seeks anticipatory bail.\n<\/p>\n<\/p>\n<p>      2.     The   learned   Public   Prosecutor   opposed   the<\/p>\n<p>application.\n<\/p>\n<\/p>\n<p>      3.     The case of the prosecution is that on 25.1.2007,  the<\/p>\n<p>petitioner had committed theft of a cheque book and forged the<\/p>\n<p>signature of a pensioner in the cheque leaf and tried to encash a<\/p>\n<p>sum   of   Rs.3,500\/-.         The   learned   Public   Prosecutor,   on<\/p>\n<p>instructions,   further   submitted   that   the   petitioner   has   also<\/p>\n<p>committed similar offence  totaling to a sum of Rs.58,500\/-.<\/p>\n<p>      4.     It   is   too   early   to   accept   the   petitioner&#8217;s   contention<\/p>\n<p>that   he   is   falsely   implicated   in   the   case.       Nevertheless,   his<\/p>\n<p>contention   that   three   other   members   of   the   staff   by   name<\/p>\n<p>Christina,   Reghu   and   Vijayakumar,   who   also   had   a   role   in<\/p>\n<p>dealing   with   the   cheque     and   who   were   suspended   but   were<\/p>\n<p>subsequently     reinstated   and   transferred   to   some   other   station<\/p>\n<p>B.A.1950\/2007<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>with   a   view   to   make   the   petitioner   a   scapegoat   is   also   worth<\/p>\n<p>consideration of the investigating agency.<\/p>\n<p>        5.    Even though anticipatory bail cannot be granted in a<\/p>\n<p>case   of   this   nature,     I   am   inclined   to     permit   the   petitioner   to<\/p>\n<p>surrender before the Investigating Officer for interrogation and<\/p>\n<p>then   to   have   his   application   for   regular   bail   considered   by   the<\/p>\n<p>Magistrate having jurisdiction.\n<\/p>\n<\/p>\n<p>        6.    Accordingly, the   petitioner    is directed to surrender<\/p>\n<p>before the Investigating Officer   on any day between     4.4.2007<\/p>\n<p>and   9.4.2007 for the purpose of  interrogation.
