Reply filed by the respondent is taken on record.<\/p>\n<p>CR No.4628 of 2008<\/p>\n<p>          At the time of motion hearing, the learned counsel for the<\/p>\n<p>petitioners made a presentation that &#8220;if the additional issues are framed, he<\/p>\n<p>will not lead any fresh evidence and will base his case upon the evidence<\/p>\n<p>already led and will argue the case on the additional issues also.&#8221;<\/p>\n<p>          In the face thereof, the learned counsel for the respondent states<\/p>\n<p>that he has no objection to the allowance of the petition.<\/p>\n<p>          The petition shall stand allowed accordingly.      The impugned<\/p>\n<p>order is set aside. The learned Trial Court shall proceed to frame the<\/p>\n<p>additional issues and conclude the trial thereafter within one month from<\/p>\n<p>the next date of hearing.\n<\/p>\n<p>          Disposed of accordingly.<\/p>\n<pre>\n\n\n\nMarch 24, 2009.
