This writ petition has been filed by the petitioner<\/p>\n<p>                   challenging the proceeding of Certificate Case No.12 of 2004-05<\/p>\n<p>                   as well as orders passed therein and for other ancillary reliefs.<\/p>\n<p>                              3. After some argument, learned counsel for the<\/p>\n<p>                   petitioner seeks permission to withdraw this writ petition in order<\/p>\n<p>                   to avail the provision of appeal as per Section 60 of the Bihar &amp;<\/p>\n<p>                   Orissa Public Demands Recovery Act, 1914.<\/p>\n<p>                              4. Accordingly, this writ petition is dismissed as<\/p>\n<p>                   withdrawn with the aforesaid liberty.\n<\/p>\n<p>                              5. If the petitioner files an appeal under Section 60 of<\/p>\n<p>                   the Act before the appropriate authority within four weeks from<\/p>\n<p>                   today along with a copy of this order as well as an interlocutory<\/p>\n<p>                   application for condoning the delay the said authority shall<\/p>\n<p>                   consider the delay caused due to the pendency of this writ petition<\/p>\n<p>                   and shall decide the appeal on merits in accordance with law.<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>                   6. If the petitioner files an interlocutory application for<\/p>\n<p>        any interim relief, the said authority shall consider the same in<\/p>\n<p>        accordance with law and decide it expeditiously.<\/p>\n<p>                                                 (S.
