                 This civil writ petition has been<\/p>\n
filed under Article 226\/227 of the Constitution<\/p>\n
of India praying for issuance of a writ in the<\/p>\n
nature of certiorari, quashing Order 11.9.2008<\/p>\n
(Annexure    P-9)     vide      which       the    case    of    the<\/p>\n
petitioner for compassionate appointment has been<\/p>\n
rejected. Further prayer made in the petition is<\/p>\n
for issuance of a writ in the nature of mandamus<\/p>\n
directing       the   respondents           to      appoint      the<\/p>\n
petitioner on compassionate grounds on account of
\n CWP No.19994 of 2008                                             [2]<\/p>\n
death of father of the petitioner.<\/p>\n
                     Rattan            Singh,         father            of      the<\/p>\n
petitioner was employed as Driver on daily wage<\/p>\n
basis    in     the       office        of    respondent          No.3         i.e.<\/p>\n
Executive            Engineer,               Field         Mechanical             &<\/p>\n
Construction          Production             Division,       Ranjit          Sagar<\/p>\n
Dam,    Shahpurkandi             Township,           Tehsil       Pathankot,<\/p>\n
District Gurdaspur. Services of Rattan Singh were<\/p>\n
terminated          in     the        year     1983.       The         order     of<\/p>\n
termination          was       challenged          before        the         Labour<\/p>\n
Court, Gurdaspur. The Labour Court, vide Award<\/p>\n
dated         10.3.1992           (Annexure            P-1)             directed<\/p>\n
reinstatement of the father of the petitioner in<\/p>\n
service with continuity of service and full back<\/p>\n
wages. It seems that award of the Labour Court<\/p>\n
was     not     implemented             and        therefore,           a      writ<\/p>\n
petition       was       filed    in     this        Court.      During         the<\/p>\n
pendency       of      the      writ     petition,          it         has     been<\/p>\n
pleaded that, father of the petitioner died. The<\/p>\n
petitioner          has        been     impleaded           in     the         said<\/p>\n
petition       in        the     place        of     his    father.            Some<\/p>\n
directions have been issued in the writ petition<\/p>\n
in view of an agreement between the parties.<\/p>\n
                     Be        that    as     it     may,     order          dated<\/p>\n
5.1.2001 (Annexure P-2) passed by this Court in<\/p>\n
the CWP No.2121 of 1985 makes it evident that the<\/p>\n
petitioner was held entitled to back wages for
\n CWP No.19994 of 2008                                              [3]<\/p>\n
the period from the date when Rattan Singh was<\/p>\n
discharged         till          the    date          of    his      death    on<\/p>\n
29.9.1994.\n<\/p>\n
                       The petitioner being dependent on<\/p>\n
his father and being the only male member, claims<\/p>\n
to    be     eligible        for       compassionate            appointment.<\/p>\n
Application for compassionate appointment in view<\/p>\n
of the death of his father was made. The case of<\/p>\n
the petitioner for appointment on the said ground<\/p>\n
has        been   rejected             by    the       respondents           vide<\/p>\n
impugned order, Annexure P-9.\n<\/p>\n
                       Impugned             Order,         Annexure          P-9,<\/p>\n
notices that the petitioner applied for getting<\/p>\n
employment on 29.11.2005 which was sent to the<\/p>\n
Head Office. The claim has been rejected in view<\/p>\n
of the fact that services of Rattan Singh had not<\/p>\n
been       regularised           and    therefore,            claim     of    his<\/p>\n
wards       cannot     be    considered            for      appointment        on<\/p>\n
compassionate grounds.\n<\/p>\n
                       The        issue          of        appointment         on<\/p>\n
compassionate grounds has been considered by the<\/p>\n
Hon’ble       Supreme        Court          of        India     in      various<\/p>\n
judgments. While dealing with S.B.I. vs. Anju Jain, (2008)<\/p>\n
8 SCC 475, it has been held that appointment on<\/p>\n
compassionate ground is never considered a right<\/p>\n
of     a    person.         In     fact,         such      appointment        is<\/p>\n
violative         of    rule       of       equality          enshrined      and
\n CWP No.19994 of 2008                                        [4]<\/p>\n
guaranteed under Article 14 of the Constitution.<\/p>\n
It has further been observed that the primary<\/p>\n
object of such scheme is to save the bereaved<\/p>\n
family from sudden financial crisis occurring due<\/p>\n
to death of the sole bread earner. It is thus<\/p>\n
exception to the general rule of equality and not<\/p>\n
another      independent               and     parallel     source       of<\/p>\n
employment. Compassionate appointment is really a<\/p>\n
concession in favour of dependents of a deceased<\/p>\n
employee.\n<\/p>\n
                   It       is    the        admitted    case      of   the<\/p>\n
petitioner that the case of the petitioner does<\/p>\n
not fall within the scope of the Scheme adopted<\/p>\n
by   the    respondents           for        giving    appointment        on<\/p>\n
compassionate           grounds.             The      appointment        on<\/p>\n
compassionate grounds not being a vested right,<\/p>\n
in my considered view, action of the respondents<\/p>\n
does       not     call          for     interference             in    writ<\/p>\n
jurisdiction.\n<\/p>\n
                   Likewise in Umesh Kumar Nagpal vs. State of<\/p>\n
Haryana & Others, (1994) 4 SCC 138, it has been observed<\/p>\n
that consideration for such employment is not a<\/p>\n
vested right which can be exercised at any time<\/p>\n
in future. The object being to enable the family<\/p>\n
to get over the financial crisis which it faces<\/p>\n
at   the    time       of   the        death    of    the   sole       bread<\/p>\n
winner, the compassionate employment cannot be
\n CWP No.19994 of 2008                               [5]<\/p>\n
claimed and offered whatever the lapse of time<\/p>\n
and after the crisis is over.\n<\/p>\n
                   Considering        the    spirit      of    the<\/p>\n
purpose of appointment on compassionate ground, I<\/p>\n
find that the case of the petitioner has no merit<\/p>\n
in so much as father of the petitioner died in<\/p>\n
1994.      The     application        for    appointment           on<\/p>\n
compassionate grounds itself was made in the year<\/p>\n
2005    i.e.     after      11   years.   Consideration       of   a<\/p>\n
person such as the petitioner would defeat the<\/p>\n
very    purpose        of   appointment     on   compassionate<\/p>\n
ground. In view of the time already elapsed, also<\/p>\n
I find no reason to interfere with the order<\/p>\n
passed by the respondents.\n<\/p>\n
                   In view of the above, the petition<\/p>\n
is dismissed.<\/p>\n
