The services of the respondent came to<br \/>\nan end w.e.f. 01.01.1988.  Being aggrieved by the said order, the<br \/>\nrespondent raised a dispute which was ultimately referred to the<br \/>\nLabour Court for adjudication being Reference [LCK] No.306\/1990.<br \/>\nBefore the Labour Court, both the parties adduced evidence and after<br \/>\nappreciating the material produced before it, the Labour Court<br \/>\nallowed the reference with the aforesaid directions. Hence, this<br \/>\npetition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The learned counsel for the petitioner submitted that the<br \/>\nrespondent had attained the age of superannuation and therefore there<br \/>\nis no question of reinstatement.  However, the Labour Court while<br \/>\ngranting reinstatement had observed that the petitioner had not<br \/>\nfollowed the due process of law before terminating the services of<br \/>\nthe respondent. Therefore, I am of the view that the Labour Court has<br \/>\nrightly passed the award qua reinstatement.\n<\/p>\n<p>4.<br \/>\n\tSo far as the question of back wages is concerned,  the Labour Court<br \/>\nhas not given any cogent reasons for awarding back wages to the<br \/>\nworkman. In view of the principle laid down by the Apex Court in the<br \/>\ncase of Ram Ashrey Singh v.\n<\/p>\n<p>Ram Bux Singh,<br \/>\n(2003) II L.L.J. Pg.176,<br \/>\na workman has no automatic entitlement to back wages since it is<br \/>\ndiscretionary and has to be dealt with in accordance with the facts<br \/>\nand circumstances of each case. Similar principle has been laid down<br \/>\nby the Apex Court in the case of <a href=\"\/doc\/1628125\/\">General<br \/>\nManager, Haryana Roadways v. Rudhan Singh,<br \/>\nJ.T.<\/a> 2005 (6) S.C.,pg. 137,<br \/>\n[2005 \/(5) S.C.C.,pg.591],<br \/>\nwherein, it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but, a host of factors<br \/>\nare to be taken into consideration before passing any such order.\n<\/p>\n<p>5.<br \/>\nIt would also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/309814\/\">A.P. State Road Transport &amp; Ors., v. Abdul<br \/>\nKareem,<\/a> (2005) 6 S.C.C. pg.36, wherein it has been held that<br \/>\na workman is not entitled to any consequential relief on<br \/>\nreinstatement as a matter of course unless specifically directed by<br \/>\nforum granting reinstatement. Looking to the facts of the case and<br \/>\nthe principle laid down by the Apex Court in the above decisions, I<br \/>\nam of the opinion that the respondent workman cannot be said to be<br \/>\nentitled for any back wages. Hence, the impugned award grating back<br \/>\nwages deserves to be quashed and set aside.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result, the petition is partly allowed. The impugned award qua<br \/>\nback wages is quashed and set aside. The respondent workman is<br \/>\nentitled  for the benefits of reinstatement from the publication of<br \/>\nthe award. However, it will be open for the petitioner to deduct the<br \/>\namount paid u\/s. 17-B while calculating the salary to be paid on the<br \/>\nbasis of regular wages and shall also pay the total dues on the basis<br \/>\nof average work. The impugned award is modified accordingly. The<br \/>\nensuing monetary benefits from the date of award shall be released<br \/>\nwithin a period of four months from the date of receipt of writ of<br \/>\nthis order.
