Justice ANTONY DOMINIC\n\n Dated :04\/01\/2011\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                 W.P.(C) No. 38617 of 2010 B\n             ```````````````````````````````````````````````````````\n           Dated this the 4th day of January, 2011\n\n                            J U D G M E N T\n<\/pre>\n<p>           Petitioner made an application to the respondent<\/p>\n<p>University for an equivalency certificate for M.Sc Computer<\/p>\n<p>Science (Distance Education) (Lateral Entry) to the Degree<\/p>\n<p>obtained by him from Annamalai University. When he made<\/p>\n<p>the    application,      the      University        issued        him Ext.P3<\/p>\n<p>communication dated 01-12-2010, requiring the petitioner to<\/p>\n<p>produce a certificate from the Annamalai University to the<\/p>\n<p>effect that the contact programme and the examination of the<\/p>\n<p>course pursued by him was conducted within the territorial<\/p>\n<p>jurisdiction of the University, as per the rules of the Distance<\/p>\n<p>Education Council\/UGC, along with the scheme and syllabus<\/p>\n<p>of the Lateral Entry Course, duly attested by the Registrar of<\/p>\n<p>the said University. It is challenging Ext.P3, this writ petition is<\/p>\n<p>filed.\n<\/p>\n<p>      2.   Counsel for the petitioner contends that, in view of<\/p>\n<p>W.P.(C) No.38617\/2010<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>Ext.P4, which evidences that the UGC has granted<\/p>\n<p>recognition to the Annamalai University, demand made in<\/p>\n<p>Ext.P3 is illegal.     I am not able to appreciate the said<\/p>\n<p>contention.    Obviously, the Annamalai University could not<\/p>\n<p>have    conducted      a  programme       outside  its  territorial<\/p>\n<p>jurisdiction. If that be so, when an application is made for<\/p>\n<p>equivalency certificate, the respondent University is perfectly<\/p>\n<p>within its power to ask for          a certificate of the nature<\/p>\n<p>mentioned      in   Ext.P3  and     on   receipt   of  the    said<\/p>\n<p>communication, it was for the petitioner to have obtained the<\/p>\n<p>certificate and produce the same before the respondent<\/p>\n<p>University to enable it to consider the petitioner&#8217;s application<\/p>\n<p>for the issuance of the equivalency certificate.
