Since
\n\tthese petitions involve the common question, the same are being
\n\tdisposed of by this common judgment.\n<\/p>\n
By
\n\tfiling these petitions, the petitioners have prayed to issue
\n\tappropriate writ, order or direction directing the respondents to
\n\textend the benefits of the Government Resolution dated 17.10.1988 to
\n\tthe petitioners from retrospective effect with 18% interest and also
\n\tto regularise the service of the petitioners in light of the
\n\tGovernment Resolution dated 17.10.1988 and to grant all
\n\tconsequential benefits.\n<\/p>\n
It
\n\tis submitted by the learned advocate appearing for the petitioners
\n\tthat the petitioners are working as daily rated employees and the
\n\tpetitioners are entitled to the benefits of the Government
\n\tResolution dated 17.10.1988.\n<\/p>\n
On
\n\tthe other-hand, it is submitted by the learned AGP appearing for the
\n\trespondents that the resolution dated 17.10.1988 was made applicable
\n\tto the daily wagers who are working for maintenance and repairs of
\n\tconstruction in various departments of the Government including the
\n\tForest Department and, therefore, the same benefits should not be
\n\textended to the petitioners herein also.\n<\/p>\n
It
\n\tis also brought to the notice of this Court that the  issue involved
\n\tin this petition has been decided by Full Bench of this court in the
\n\tcase of Gujarat Forest Producers, Gatherers and Forests Workers
\n\tUnion V\/s State of Gujarat, reported in 2004(2) GLH 302. In the said
\n\tdecision, this Court has held that the Government Resolution dated
\n\t17.10.1988 is applicable to the daily wagers of the Forest and
\n\tEnvironment Department engaged in the work of maintenance and
\n\trepairs of constructions in that department and not to the daily
\n\twagers engaged in any other types of work in that department.\n<\/p>\n
In
\n\tthe present case, as submitted by the learned AGP that the
\n\tpetitioners are not working as  daily wagers   engaged in the work
\n\tof maintenance and repairs of construction.  Since the Government
\n\tResolution dated 17.10.1988 is not applicable to the case of the
\n\tpetitioners, the grievance raised by the petitioners in these
\n\tpetitions cannot be entertained.\n<\/p>\n
Under
\n\tthe circumstances, I do not find any substance in these petitions
\n\tand therefore, the same deserve to be dismissed. Accordingly, these
\n\tpetitions are dismissed. Rule is discharged. Interim relief, if any,
\n\tgranted earlier stands vacated.\n<\/p>\n
