Amin-original petitioner working<br \/>\n     with   respondent-Diwan    Ballubhai   Secondary  School,<br \/>\n     Kankaria, Ahmedabad, had filed writ petition before this<br \/>\n     Court, being Special Civil Application No.3541 of 1996,<br \/>\n     and prayed that opponent No.1-the Director, Accounts and<br \/>\n     Treasury Office, Ahmedabad, be directed to pay pension on<br \/>\n     account of his pensionable service of 27 years (after<br \/>\n     capitalising about 1\/3 amount) and the allowance declared<br \/>\n     from time to time by the Government and medical and other<br \/>\n     allowance declared by the Government with interest.<br \/>\n     Learned Single Judge of this Court, by his judgment and<br \/>\n     order dated 23.4.1998, allowed the writ petition and held<br \/>\n     that the claim of the petitioner for Rs.35,010\/- was<br \/>\n     justified and that he was entitled for simple interest at<br \/>\n     the rate of 12% instead of compound interest at the rate<br \/>\n     of   18%   percent    prayed for and, accordingly, the<br \/>\n respondents were ordered to pay the same within three<br \/>\nmonths from the date of the order, i.e. 23.4.1998. This<br \/>\norder passed by the learned Single Judge of this Court<br \/>\nwas challenged by the appellants in the above Letters<br \/>\nPatent Appeal No.135 of 1998, which was barred by period<br \/>\nof limitation by 257 days. Therefore, the above Civil<br \/>\nApplication     No.1496    of    1999   was   filed  by the<br \/>\napplicants-appellants for condoning delay of 257 days in<br \/>\nfiling the appeal.        Division Bench of this Court on<br \/>\n8.10.2001, had issued Rule and made it returnable on 5th<br \/>\nNovember, 2001.       Thereafter, from time to time, the<br \/>\nmatter was adjourned and could not be heard and finally<br \/>\ndisposed of till today. Meanwhile, during the pendency<br \/>\nof the aforesaid Civil Application and Letters Patent<br \/>\nAppeal, the sole respondent-Chinubhai R. Amin expired on<br \/>\n22nd    March,     2001,   before the admission of Civil<br \/>\nApplication No.1496 of 1999 for condonation of delay.<br \/>\nTherefore,     the    applicants    have filed above Civil<br \/>\nApplication No.2113 of 2003 for bringing the heirs of the<br \/>\nsole respondent-original petitioner-Chinubbhai R.       Amin<br \/>\non record.      On 24th March, 2003, Division Bench of this<br \/>\nCourt had ordered to issue notice to the proposed heirs<br \/>\nand made it returnable on 29th April, 2003. In response<br \/>\nto the said notice, learned counsel, Shri Hardik Raval,<br \/>\nappears     for      the    proposed    heirs   of  original<br \/>\npetitioner-Chinubhai R. Amin.\n<\/p>\n<p>2.There is a letter dated 1.11.2001 addressed by<br \/>\nthe respondent-Diwan Ballubhai Secondary School. From<br \/>\nthe said letter, it is clear that, as per the order, the<br \/>\namount    was    already    paid    to    the    original<br \/>\npetitioner-deceased Chinubhai R. Amin. Not only that, a<br \/>\nletter dated 1.5.2000 addressed by the District Education<br \/>\nOfficer, Ahmedabad City, to the Principal of the School<br \/>\nshows that the school was directed to make the payment to<br \/>\nShri Amin, as per the order passed by the learned Single<br \/>\nJudge of this Court in the Special Civil Application.<br \/>\nThus, the order passed by the larned Single Judge of this<br \/>\nCourt on 23rd April, 1998, has been complied with long<br \/>\nback.   Under the circumstances, the aforesaid Civil<br \/>\nApplication as well as the Letters Patent Appeal were<br \/>\nrequired to be dismissed straightaway.      However, the<br \/>\nlearned Assistant Government Pleader submitted that, if<br \/>\nthe heirs of the respondent, deceased-Chinubhai R. Amin,<br \/>\nare not brought on record and, if the delay is not<br \/>\ncondoned, then the order passed by the learned Single<br \/>\nJudge would remain on record and it would become a<br \/>\nbinding precedent.    Therefore, though the order was<br \/>\ncomplied with by the present appellants, on principle,<br \/>\nthe challenge is made.      The apprehension expressed by<br \/>\nShri Pancholi can be taken care of by observing that,<br \/>\n while deciding the matter, we have not gone into the<br \/>\nmerits of the case and, without expressing any opinion on<br \/>\nthe legality and validity of the order passed by the<br \/>\nlearned Single Judge, Letters Patent Appeal was required<br \/>\nto be disposed of mainly on two grounds, (1) that the<br \/>\norder   was   complied   with long back and (2) that<br \/>\nrespondentpetitioner-Chunibhai R. Amin died long back.\n<\/p>\n<p>3.In view of the above, Shri Raval, for the<br \/>\nproposed heirs of the opponent-Chinubhai R. Amin has no<br \/>\nobjection in granting Civil Application No.2113 of 2003.<br \/>\nAccordingly, Civil Application No.2113 is granted and the<br \/>\nproposed heirs of deceased opponent-Chinubhai R. Amin<br \/>\nare brought on record. Civil Application No.2113 of 2003<br \/>\nis, accordingly, allowed by condoning the delay in filing<br \/>\nthe same.\n<\/p>\n<p>4.This brings us to Civil Application No.1496 of<br \/>\n1996 for condoning the delay in filing the appeal. In<br \/>\nview of what has been observed by us, Mr. Raval for the<br \/>\nrespondents-proposed heirs of original petitionerdeceased<br \/>\nChinubhail R.    Amin has no objection in granting the<br \/>\napplication for condonation of delay. Accordingly, Civil<br \/>\nApplication No.1496 of 1999 filed in Letters Patent<br \/>\nAppeal No.135 of 1999 for condoning the delay is allowed<br \/>\nand Rule is made absolute with no order as to costs.\n<\/p>\n<p>5.This brings us to main Letters Patent Appeal<br \/>\nNo.135 of 1999.    As stated earlier, we are not inclined<br \/>\nto interfere with the order passed by the learned Single<br \/>\nJudge of this Court on 23.4.1998 mainly for two reasons,<br \/>\n(1) that the order impugned was complied with by the<br \/>\npresent appellants long back and (2) that the original<br \/>\npetiitoner-Chinubhai R. Amin has expired long back.    On<br \/>\nmerits, we are not inclined to express any opinion about<br \/>\nthe legality and validity of the order passed by the<br \/>\nlearned Single Judge of this Court, allowing the writ<br \/>\npetition filed by the      original   petitioner-deceased<br \/>\nChinubhai R.   Amin.    However, we make it clear that,<br \/>\nwithout expressing any opinion, we have dismissed this<br \/>\nappeal mainly on the aforesaid two grounds, therefore, it<br \/>\ncan never become a precedent, more particularly, when the<br \/>\nlearned Single Judge himself, on facts on this case,<br \/>\nwithout laying down the law, has decided the matter.\n<\/p>\n<p>6.Civil Application No.1497 of 1999 in Letters<br \/>\nPatent Appeal No.135 of 1999, praying for stay of the<br \/>\norder of the learned Single Judge, is dismissed as the<br \/>\nmain Letters Patent Appeal is dismissed.\n<\/p>\n<p>[ B.
