Relevant part of the said order reads as under:\n<\/p>\n<p> For<br \/>\n\tthe reasons recorded hereinabove, the petition is allowed. The<br \/>\n\timpugned order dated 28th  February, 1986, (Annexure-F to<br \/>\n\tthe petition) is quashed and set aside. The petitioner shall be paid<br \/>\n\tthe amount of difference of pension within a period of three months<br \/>\n\tfrom today. The question of regularisation of period of suspension<br \/>\n\tand further promotion should be examined by the concerned authority<br \/>\n\tand the order shall be made in accordance with law within a period<br \/>\n\tof six months from today. Registry is directed to send the writ<br \/>\n\tforthwith.\n<\/p>\n<p>We<br \/>\n\thave heard the counsels appearing for both the sides and it appears<br \/>\n\tthat:\n<\/p>\n<p>(i)<br \/>\n\tinitially an inquiry was instituted against the present applicant<br \/>\n\tand a penalty was imposed for deduction of Rs.1,000\/- from the<br \/>\n\tpension of the present applicant.\n<\/p>\n<p>(ii)<br \/>\n\tthe aforesaid order of penalty was challenged in Special Civil<br \/>\n\tApplication No.2902 of 1996. Said petition was allowed vide order<br \/>\n\tdated 23rd and 24th March, 1999 and the<br \/>\n\trelevant part of the direction is stated hereinabove.\n<\/p>\n<p>(iii)<br \/>\n\tin view of the aforesaid direction, it appears that the respondents<br \/>\n\thave already paid an amount of Rs.56,729\/- on 19th of<br \/>\n\tMarch, 2000. It also appears that the second direction given in the<br \/>\n\taforesaid writ petition was to consider the case for promotion of<br \/>\n\tthe present applicant within stipulated time.\n<\/p>\n<p>(iv)<br \/>\n\tit is submitted by the counsel for the applicant that a decision was<br \/>\n\talready taken by the concerned respondent authorities slightly<br \/>\n\tbeyond the period of six months to the effect that one more inquiry<br \/>\n\twas pending and therefore, the case of the applicant for promotion<br \/>\n\twas not considered.\n<\/p>\n<p>(iv)<br \/>\n\tbasis of second decision taken by the Government rejecting the claim<br \/>\n\tof the applicant for promotion was also challenged by way of Special<br \/>\n\tCivil Application No.3412 of 1996. It is also decided in favour of<br \/>\n\tthe present applicant vide order dated 17th October,<br \/>\n\t2007. But the fact remains that the earlier order passed by this<br \/>\n\tCourt on 23rd and 24th March, 1999 in Special<br \/>\n\tCivil Application No.2902 of 1996 is already complied with. Decision<br \/>\n\thas also been taken about the promotion of the present applicant.<br \/>\n\tThe amount which was directed to be paid was also paid as stated<br \/>\n\thereinabove.\n<\/p>\n<p>Thus,<br \/>\n\tthere is no disobedience of the order passed by this Court dated<br \/>\n\t23rd and 24th March, 1999 in Special Civil<br \/>\n\tApplication No.2902 of 1996 much less a wilful disobedience.\n<\/p>\n<p>Counsel<br \/>\n\tfor the applicant submitted that the reason for which the promotion<br \/>\n\twas denied to the present applicant is no more in existence because<br \/>\n\tof the order passed by this Court in Special Civil Application<br \/>\n\tNo.3412 of 1996 dated 17th October, 2007 and for this,<br \/>\n\tthe applicant will pursue this matter before the concerned<br \/>\n\trespondent authorities.\n<\/p>\n<p>In<br \/>\n\tview of the above facts, there is no substance in this application<br \/>\n\tand hence the same is dismissed. Rule is discharged.
