He submitted that the trial will take a long<br \/>\ntime to complete.  From the documents on record, he pointed out that<br \/>\ninsofar as the present petitioners are concerned, no role is<br \/>\nattributed to  them of having caused any injuries to the deceased or<br \/>\nanyone else, on the side of the complainant.  He, further, submitted<br \/>\nthat the firing from fire arms, which caused fatal injuries, was done<br \/>\nby the other accused. He, further, pointed out that a co-accused<br \/>\nNasirkhan Bismillakhan Jatmal has been released on bail by this<br \/>\nCourt, by an order dated 08.02.2011.\n<\/p>\n<p>2.\t\tOn<br \/>\nthe other hand, learned APP opposed this petition, contending that<br \/>\nthe petitioners were present at the scene of offence and supported<br \/>\nthe other accused, when the incident took place.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that the are in jail since June, 2009.  the trial is unlikely<br \/>\nto complete shortly.  Co-accused has been released on bail.  Further,<br \/>\nI have also perused the FIR as well as the documents accompanying<br \/>\nthis petition.  The role of the petitioners is stated in the FIR.<br \/>\nThe petitioners are not stated to have fired from any fire arms or<br \/>\nhave given any fatal blow to the deceased with the help of any other<br \/>\nweapon. Considering<br \/>\nthe above, prima facie,<br \/>\naspects of the matter and considering<br \/>\nthat the trial is unlikely to complete shortly and since<br \/>\ncharge-sheet is also filed,<br \/>\nI find this is a fit case for granting bail. Under the circumstances,<br \/>\nthe petitioners are ordered to be released on bail in connection with<br \/>\nC.R. NO. I-39\/2009,<br \/>\nregistered with PATDI<br \/>\nPOLICE STATION, for<br \/>\nthe offences punishable under Sections-302, 307, 324, 343, 147, 148,<br \/>\n149 of the Indian Penal Code, Section-25(1)(d) of the Arms Act and<br \/>\nSection-135 of the Bombay Police Act, on their furnishing bond of<br \/>\nRs.25,000\/-(Rupees Ten Thousand), by EACH<br \/>\nof them, with one surety of the like amount to the satisfaction of<br \/>\nthe lower Court and subject to the conditions that, they shall:\n<\/p>\n<p>(1).\t\tnot<br \/>\ntake undue advantage of the liberty or abuse the liberty;\n<\/p>\n<p>(2).\t\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(3).\t\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(4).\t\tmark<br \/>\npresence before the SURENDRANAGAR CITY Police Station<br \/>\non every 1st and 15th day of English Calendar<br \/>\nmonth between 11:00 a.m. to 2:00 p.m.;\n<\/p>\n<p>(5).\t\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(6).\t\tfurnish<br \/>\nthe address of residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of  this<br \/>\nCourt;\n<\/p>\n<p>(7).\t\tsurrender<br \/>\nthe passports, if any, to the Lower Court immediately<\/p>\n<p>(8)\t\tNOT<br \/>\nENTER within the revenue limits of PATDI TALUKA,<br \/>\ntill the completion of the trial.\n<\/p>\n<p>4.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>5.\t\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>6.\t\tRule<br \/>\nis made absolute.
