  at  faots of the case are:\n<\/p>\n
 14.03.2006, when the claimant was<\/p>\n
 pp pproeeveding in a Moped bearing registration No.<\/p>\n
l ‘-.V_V’E<Au\u00a5O9eFA-2880 as a pillion rider towards Bailaia Circle<\/p>\n
"linear under bridge, Mysore, a car bearing registration<\/p>\n

No. KA–09–M–3885 came with high speed and in a rash
\nand negligent rnanrier and dashed agaisnt the Moped,<\/p>\n
as a result, the claimant fell down <\/p>\n
injuries. Hence, he \ufb01led a claim petition’ before this ”<\/p>\n
MACT, Channarayapatna, seelring ,_ Ear<\/p>\n
Rs.4,00,000\/–. The Tribunal <\/p>\n
and award has awarded cofn;oensationV_ of fRs..’1:,6Vl,907\/–V<\/p>\n
with interest at 6%\n<\/p>\n
5. As there is no occurrence of<\/p>\n
accident,  the insurer of the<\/p>\n
offending. the”–only”‘point that remains for my

l  that the compensation awarded by the Tribunal is<\/p>\n
 not just and proper, it is on the lower side and therefore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n<\/p>\n
7. The claimant has sustained fracture of tibia and
\nfibula of right leg. Injuries sustained by him are<\/p>\n
evident from wound certificate — <\/p>\n

8. Considering the Rs.40,000\/–<\/p>\n
awarded byiriburial and suffering is<\/p>\n
just an’d -properiifand’-th–ere  scope for enhancement<\/p>\n
under,thiS head;  V.\n<\/p>\n
9. AsRs.8′?l8_bC:_\/”–‘.a’warded by the Tribunal towards<\/p>\n
 expelnsesis as per medical bills produced by<\/p>\n
V   same is just and proper and therefore,<\/p>\n
it does ‘not call for enhancement.<\/p>\n
10. ~. Claimant was treated as inpatient for 12 days in<\/p>\n

l?Considering the same, Rs.2,400\/– awarded by the<\/p>\n

Tribunal towards incidental expenses such as

    Claimant has to bear with the disability stated by<\/p>\n
lfthe doctor in addition to certain amount of discomfort<\/p>\n
