Justice V.GIRI\n\n Dated :13\/08\/2009\n\n O R D E R\n                              V.GIRI,J.\n                       -------------------------\n                  W.P ( C) No.23068 of 2009\n                      --------------------------\n               Dated this the 13th August,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>     Petitioner claims that her husband was a freedom<\/p>\n<p>fighter involved in the Punnapara-Vayalar struggle. He<\/p>\n<p>was also a recipient of freedom fighters pension under the<\/p>\n<p>State.   Petitioner then applied to the 1st respondent for<\/p>\n<p>pension under the Swathanthrata Sainik Samman Pension<\/p>\n<p>Scheme(Central Scheme) as evidenced by Ext.P1.           The<\/p>\n<p>scheme contemplates eligibility to be determined by an<\/p>\n<p>enquiry by the District Collector or person acting at the<\/p>\n<p>instance of the District Collector and report being<\/p>\n<p>forwarded to the State Government. The State Government<\/p>\n<p>shall therefore make its recommendation to the Central<\/p>\n<p>Government. This process, according to the petitioner, has<\/p>\n<p>been unduly delayed and hence the writ petition.<\/p>\n<p>     2.    Heard learned Government Pleader also.<\/p>\n<p>     3.    If Ext.P1 is still pending consideration, then the<\/p>\n<p>District Collector shall    see that the enquiry therein is<\/p>\n<p>completed, within a period of three months from the date<\/p>\n<p>W.P ( C) No.23068 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>of receipt of a copy of this judgment and report shall be<\/p>\n<p>forwarded to the State Government within the said time<\/p>\n<p>frame. Thereafter, the State Government shall forward its<\/p>\n<p>recommendation to the Central Government within a period<\/p>\n<p>of  two     months    thereafter.
