The applicant was in love with the<br \/>\ncomplainant for last 7 years. He further submitted that the applicant<br \/>\nis an innocent person and  therefore, he is required to be enlarged<br \/>\non bail. It is love affairs of the applicant and prosecutrix. The<br \/>\napplicant and prosecutrix are the students and staying at Patan. Even<br \/>\nthe statement of driver of rickshaw has not been recorded. Therefore,<br \/>\nthe applicant may be granted bail.\n<\/p>\n<p>\tLearned APP<br \/>\nMr. Parikh appearing on behalf of the respondent &#8211; State<br \/>\nsubmitted that the applicant is involved in the serious offence and,<br \/>\ntherefore, considering the seriousness of offence, he is not entitled<br \/>\nto grant regular bail. Therefore, the application of the applicant<br \/>\nmay be rejected.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Buch appearing on behalf of the complainant submitted<br \/>\nthat the applicant is not required to be granted bail. He has<br \/>\nproduced affidavit-in-reply of the complainant, which is taken on<br \/>\nrecord. The applicant is involved in the serious offence and he has<br \/>\ndeep political root in the society. Therefore, he may not be enlarged<br \/>\non bail. Mr. Buch, learned advocate lastly submitted that if the<br \/>\napplicant is released on bail, then also, some stringent conditions<br \/>\nmay be imposed upon the applicant while releasing him on bail.\n<\/p>\n<p>\tParties do not<br \/>\npress for further reasoned order.\n<\/p>\n<p>\tI have also<br \/>\nperused the averments made in the application as well as the FIR<br \/>\nproduced on the record. It is a case of only love affairs and there<br \/>\nis no any direct evidence prima facie against the applicant.<br \/>\nConsidering the above, I am of the view that the applicant is<br \/>\nrequired to be enlarged on regular bail at this stage, without<br \/>\ndiscussing the evidence in detail.\n<\/p>\n<p>\tIn the facts<br \/>\nand circumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with CR<br \/>\nNo.I &#8211; 124 of 2010 registered at Patan City Police Station, on<br \/>\nexecuting a bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot leave<br \/>\nthe State of Gujarat without the prior permission of the Sessions<br \/>\ncourt concerned;\n<\/p>\n<p>[e]\tnot contact<br \/>\nthe prosecutrix till the trial is over;\n<\/p>\n<p>[f]\tfurnish the<br \/>\npresent address of his residence to the I.O. and also to the Court at<br \/>\nthe time of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or to take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>\tBail bond to<br \/>\nbe executed before the lower Court having jurisdiction to try the<br \/>\ncase.\n<\/p>\n<p>\tAt the trial,<br \/>\nthe Trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>\tRule is made<br \/>\nabsolute to the aforesaid extent.\tDirect Service is permitted.\n<\/p>\n<p>(Z.K.SAIYED,<br \/>\nJ.)<\/p>\n<p>ynvyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Desai vs State on 13 September, 2010 Author: Z.K.Saiyed,&amp;Nbsp;
