Justice M.C.HARI RANI\n\n Dated :23\/11\/2010\n\n O R D E R\n            K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                      W.P.C.No.30970 of 2010\n                    ----------------------------------------\n           Dated this the 23rd day of November 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>K.M.JOSEPH,J<\/p>\n<p>     The petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>           i)    To declare that the petitioner is entitled to<\/p>\n<p>           conduct his LPG distributorship without any<\/p>\n<p>           obstruction or hindrance from anybody including<\/p>\n<p>           the Respondents 4 and 5 and their members;<\/p>\n<\/blockquote>\n<blockquote><p>           ii)   To issue a writ of Mandamus or any other<\/p>\n<p>           writ, direction or order directing Respondents 1<\/p>\n<p>           to 3 to provide adequate police protection to the<\/p>\n<p>           petitioner, his men and his establishment in the<\/p>\n<p>           event of any situation or unlawful activities<\/p>\n<p>           committed by the Respondents 4 and 5 and their<\/p>\n<p>           men, in the process of supplying LPG Cylinders<\/p>\n<p>           to consumers;\n<\/p><\/blockquote>\n<blockquote><p>     2.   Briefly put, the case of the petitioner is as follows:<\/p><\/blockquote>\n<p>     3.   The petitioner is an authorised distributor of LPG<\/p>\n<p>under the Indian Oil Corporation Ltd. and his office and godown<\/p>\n<p>are situated at Mattannur in Kannur District. The petitioner<\/p>\n<p>belongs to Scheduled Caste. It is his further case that a very<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.30970 of 2010           2<\/span><\/p>\n<p>large area of Kannur district, mostly remote villages falls under<\/p>\n<p>the service area of the petitioner&#8217;s distributorship. About 38000<\/p>\n<p>connections have been given from the petitioner&#8217;s agency. It is<\/p>\n<p>stated that due to shortage of supply, there will be some delay in<\/p>\n<p>supplying     filled  cylinders to  consumers.        But  without<\/p>\n<p>understanding the helplessness of the petitioner, the consumers<\/p>\n<p>under the leadership of respondents 4 and 5 are creating<\/p>\n<p>problems in distributing the cylinders by obstructing the<\/p>\n<p>petitioner&#8217;s vehicles, harassing his employees and forcefully<\/p>\n<p>taking away cylinders meant for distribution. It is also his case<\/p>\n<p>that even though a distributorship of I.O.C is sanctioned at Iritty<\/p>\n<p>within the area now served by the petitioner, so far the<\/p>\n<p>distributorship has not started functioning and it is expected that<\/p>\n<p>when the distributorship starts functioning the consumers&#8217;<\/p>\n<p>complaints will be solved to some extent.\n<\/p>\n<p>      4.     We have already passed an interim order in the<\/p>\n<p>matter. We dispose of the writ petition directing that in case the<\/p>\n<p>petitioner complains of any obstruction by the members of<\/p>\n<p>respondents 4 and 5 to the distribution of L.P.G filled cylinders<\/p>\n<p>in accordance with law before respondents 2 and 3, they will<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.30970 of 2010            3<\/span><\/p>\n<p>look into it and if the complaint is found to be genuine, they shall<\/p>\n<p>provide protection to the distribution of L.P.G filled cylinders by<\/p>\n<p>the petitioner in accordance with law, as against obstruction by<\/p>\n<p>members of respondents 4 and 5.
