The present criminal appeal has been filed by<br \/>\nthe appellant Sushil Kumar challenging the judgment dated<br \/>\nNovember 6, 1989 passed by the learned Additional Sessions<br \/>\nJudge, Ludhiana whereby the appellant has been convicted<br \/>\nunder Sections 366 and 376 IPC and sentenced to undergo<br \/>\nseven years rigorous imprisonment under Section 376 IPC.<br \/>\nThe appellant has further been sentenced to undergo<br \/>\nrigorous imprisonment for three years under Section 366<br \/>\nIPC.\n<\/p>\n<p> 2. The prosecution version is that on June 16, 1988<br \/>\nRoshan Lal brother of Anju Bala was asleep in his house.<br \/>\nHis wife Sudesh Rani was also present. Around 3.00 p.m.,<br \/>\nAnju Bala, prosecutrix went to the house of her friend<br \/>\nRubi. Earlier also she had been visiting the house of her<br \/>\nfriend Rubi, but on that day she did not return back till<br \/>\nlate in the evening. Roshan Lal and his family members<br \/>\nsearched Anju Bala in the town and thereafter in the<br \/>\nhouses of their relatives but she was not traceable.<br \/>\nThereafter, Roshan Lal suspected that their neighbour<br \/>\nParshotam Lal son of Hushiar Singh, who was not present in<br \/>\nhis house, had kidnapped her. Subsequently, a wireless<br \/>\nmessage was received from the Deputy Commissioner Police<br \/>\nWest, Delhi to the effect that the aforesaid Anju Bala<br \/>\nalongwith Sushil Kumar accused and Ram Dhani accused had<br \/>\nbeen arrested in connection with FIR No. 290 dated June<br \/>\n18, 1988 under Section 294 IPC, registered at Police<br \/>\nStation Rajauri Garden, Delhi. The police brought the<br \/>\naforesaid Sushil Kumar to Ludhiana. He was go medically<br \/>\nexamined. Ultimately, it was found that the aforesaid<br \/>\nSushil Kumar had abducted Anju Bala who was a minor being<br \/>\n16 years of age and had committed rape upon her.<br \/>\nAccordingly, the appellant alongwith Ram Dhani was tried<br \/>\nunder Sections 363, 366, 368, 376 IPC. After the conclusion<br \/>\nof the prosecution evidence, the learned trial Judge<br \/>\nacquitted Ram Dhani but found that Sushil Kumar was guilty<br \/>\nof the offences for which he was charged. Accordingly, he<br \/>\nwas convicted under Sections 366\/376 IPC and sentenced as<br \/>\naforesaid.\n<\/p>\n<p>3.  I have heard Shri D.S. Keer, the learned counsel<br \/>\nfor the appellant and Shri Sandeep Jain, the learned<br \/>\nAssistant Advocate General, Punjab for the respondent and<br \/>\nwith their assistance have also gone through the record.\n<\/p>\n<p> 4. In my considered opinion, the prosecution has<br \/>\nbeen able to prove the guilt of the accused beyond all<br \/>\nreasonable doubts by leading cogent evidence. Anju Bala<br \/>\nprosecutrix has appeared as PW4. She has given a detailed<br \/>\naccount of her kidnapping and rape. She has specifically<br \/>\nstated that at the relevant time she was the student of<br \/>\n7th class and that accused Sushil Kumar was known to her<br \/>\nbecause he was living in a house at the back of their<br \/>\nhouse in Indra colony, Ludhiana. Whenever she would go<br \/>\nout of her house, the aforesaid Sushil Kumar would make<br \/>\ngestures to her. In fact, a bare perusal of the statement<br \/>\nof Anju Bala shows not only that she has supported the<br \/>\nprosecution version with regard to her kidnapping but also<br \/>\nproved the factum of she having been raped by Sushil<br \/>\nKumar. The age of the prosecutrix Anju Bala stands duly<br \/>\nproved by the prosecution by producing her school<br \/>\ncertificate Ex.PB on the record. In this view of the<br \/>\nmatter, the conviction as recorded by the learned trial<br \/>\nJudge calls for no interference and is hereby maintained.\n<\/p>\n<p> 5. Faced with this difficulty, Shri Keer, the<br \/>\nlearned counsel for the appellant has submitted that the<br \/>\naforesaid occurrence had taken place in the year 1988 when<br \/>\nthe present appellant Sushil Kumar was merely 17 years of<br \/>\nage. Although, Shri Keer tried to plead that there was a<br \/>\nconsent between the parties but because of the fact that<br \/>\nthe age of the prosecutrix Anju Bala is shown to be less<br \/>\nthan 16 years, therefore, the aforesaid plea is not<br \/>\nnaturally available to the learned counsel for the<br \/>\nappellant.\n<\/p>\n<p> 6.<br \/>\nUnder these circumstances, Shri Keer has<br \/>\nsubmitted that a lenient view of the matter be taken. It<br \/>\nis also submitted by Shri Keer that the appellant has<br \/>\nalready faced long and protracted criminal proceedings.<br \/>\nEven the present criminal appeal has remained pending in<br \/>\nthis Court or a period of more than 13 years.\n<\/p>\n<p> 7. I have given my thoughtful consideration to<br \/>\nthis plea of Shri Keer. In my considered opinion, the<br \/>\nends of justice would be met if the sentence of rigorous<br \/>\nimprisonment awarded to the appellant Sushil Kumar is<br \/>\nreduced to two years under Section 376 IPC and 6 months<br \/>\nunder Section 366 IPC. Both the aforesaid sentences shall<br \/>\nrun concurrently.\n<\/p>\n<p> 8.
