A recovery certificate dated 6.6.2002 was sought to<\/p>\n<p>be enforced against the appellant. The certificate in question<\/p>\n<p>has been issued by the Collector, Lucknow, UP. It is addressed<\/p>\n<p>to the Collector New Delhi. The certificate reads as under:-<\/p>\n<blockquote><p>        &#8220;Against S\/Shri Premier Vinyl Flooring Ltd., and O.N.<br \/>\n        Goenka, s\/o Shri K.N.Goenka, resident of K-13, Hauz<br \/>\n        Khas Enclave, New Delhi Rs.58357394\/- (+ illegible) is<br \/>\n        remaining due for recovery and whose moveable and<br \/>\n        immoveable property is situated in your District.<br \/>\n        Hence under the provisions of Revenue Recovery Act,<br \/>\n        the amount may be recovered as arrears of land<br \/>\n        revenue and the amount be sent to concerned<br \/>\n<span class=\"hidden_text\">    LPA No.227\/2006                                       Page 1 of 3<\/span><br \/>\n       department directly. In this context kindly take the<br \/>\n      trouble of making future correspondence with them.&#8221;\n<\/p><\/blockquote>\n<p>2.          Now, the appellant is neither Premier Vinyl Flooring<\/p>\n<p>Ltd. nor O.N.Goenka, the two persons against whom the<\/p>\n<p>certificate is directed.\n<\/p>\n<p>3.          When sought to be executed against the appellant<\/p>\n<p>by a coercive process, a writ petition was filed alleging that the<\/p>\n<p>certificate, being not directed against the appellant, could not<\/p>\n<p>be executed against him.\n<\/p>\n<p>4.          The writ petition has been dismissed vide impugned<\/p>\n<p>order dated 18.11.2005 on the ground that the certificate has<\/p>\n<p>been issued from Lucknow and thus, this Court would have no<\/p>\n<p>jurisdiction to entertain the writ petition.<\/p>\n<p>5.          It may be noted that in the writ petition, the validity<\/p>\n<p>of the recovery certificate was questioned on various grounds,<\/p>\n<p>but in appeal today, learned Senior Counsel for the appellant<\/p>\n<p>restrict submissions to only one. It is urged that the appellant<\/p>\n<p>does not question the legality and validity of the certificate but<\/p>\n<p>seeks relief pertaining to non execution thereof against the<\/p>\n<p>appellant for the reason, the certificate is not directed against<\/p>\n<p>the appellant. The appellant is not the person named in the<\/p>\n<p>certificate against whom recovery has to be effected.<\/p>\n<p>6.          It is trite that to be executed against the properties<\/p>\n<p>of a person or to be enforced by the coercive process of<br \/>\n<span class=\"hidden_text\"> LPA No.227\/2006                                           Page 2 of 3<\/span><br \/>\n imprisonment, a recovery certificate must disclose on its face<\/p>\n<p>that the same has to be executed by attachment of the<\/p>\n<p>property of the persons named in the certificate or by way of<\/p>\n<p>imprisonment (civil) of the person concerned.<\/p>\n<p>7.          This is not so on the face of the certificate in<\/p>\n<p>question.\n<\/p>\n<p>8.          The respondents are advised to obtain a proper<\/p>\n<p>certificate after following the process of law, if the respondent<\/p>\n<p>claims any joint and\/or several liability of the appellant to clear<\/p>\n<p>the dues in its favour.\n<\/p>\n<p>9.          The appeal stands disposed of directing that the<\/p>\n<p>impugned certificate, contents whereof have been noted in<\/p>\n<p>para 1 above shall not be executed against the appellant<\/p>\n<p>either by way of attachment of his property or by detaining<\/p>\n<p>him in civil prison. It is made clear that it would be open to the<\/p>\n<p>respondent to obtain a proper recovery certificate after<\/p>\n<p>following the process of law and then execute the same as per<\/p>\n<p>law.\n<\/p>\n<p>10.
