GOPINATHAN, J\n               - - - - - - - - - - - - - - - - - - - - - - -\n                   Crl.R.P.No. 3092 of 2009\n               - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 13th day of October, 2009\n\n                              O R D E R\n<\/pre>\n<p>     1.    Revision petitioners are the sureties of the<\/p>\n<p>accused in C.P. No.108\/2008 of on the files of Judicial<\/p>\n<p>Magistrate of the First Class, Irinjalakuda.                  They got<\/p>\n<p>released the accused, who was facing trial for offences<\/p>\n<p>under Section 376 IPC and 3 (1) XI of the Scheduled Castes<\/p>\n<p>and the Scheduled Tribes (Prevention of Atrocities) Act, on<\/p>\n<p>bail after executing a bond for Rs.10,000\/- with undertaking<\/p>\n<p>of produce the accused as and when called upon. But they<\/p>\n<p>failed to produce the accused. Consequently the bail bond<\/p>\n<p>was forfeited and notice was issued to the revision<\/p>\n<p>petitioners calling upon them to show cause for not<\/p>\n<p>imposing penalty. Though they entered appearance and<\/p>\n<p>sought for time to produce the accused, later they failed<\/p>\n<p>and remained absent. In their absence, taking note that<\/p>\n<p>they had no cause to be shown for not imposing penalty, the<\/p>\n<p>Crl.R.P.No. 3092 of 2009<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>learned Magistrate by order dated 22.05.2006 imposed a<\/p>\n<p>penalty of Rs.10,000\/- each. Feeling aggrieved they<\/p>\n<p>preferred Crl.A. No.469\/20006 before the Sessions Judge,<\/p>\n<p>Thrissur. The learned Sessions Judge declined to interfere<\/p>\n<p>with the impugned order. Assailing the legality, correctness<\/p>\n<p>and propriety of the above order imposing penalty as<\/p>\n<p>confirmed in appeal this revision petition was filed.<\/p>\n<p>      2.     Learned counsel for the revision petitioners didn&#8217;t<\/p>\n<p>assail the order imposing penalty.       Only the quantum is<\/p>\n<p>disputed. It is submitted that the revision petitioners had<\/p>\n<p>later produced the accused before the committal court and<\/p>\n<p>the case was committed to the sessions court and in the<\/p>\n<p>above circumstances the revision petitioners are entitled to<\/p>\n<p>a little more leniancy.     In proof of the submission, the<\/p>\n<p>learned counsel had produced copy of summons issued from<\/p>\n<p>the Sessions Court to the accused. It is also submitted that<\/p>\n<p>the revision petitioners are rustic villagers and the penalty<\/p>\n<p>imposed is excessive.\n<\/p>\n<p>      3.     Taking into account of the above circumstances<\/p>\n<p>Crl.R.P.No. 3092 of 2009<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>and facts of the case I find that the penalty imposed is<\/p>\n<p>excessive and that the Revision Petitioners are entitled to<\/p>\n<p>leniency and that a penalty of Rs.5,000\/- each would met the<\/p>\n<p>ends of justice.\n<\/p>\n<p>      4.     In the result, the Revision Petition is allowed in<\/p>\n<p>part.    While confirming the order imposing penalty, the<\/p>\n<p>quantum is reduced to Rs.5,000\/- (Rupees Five thousand<\/p>\n<p>only) each.\n<\/p>\n<\/p>\n<p>                                          P.S.
