SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 07\/10\/2011 \nCOMMON ORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nmeans of these writ petitions, the<br \/>\npetitioner has prayed for the following reliefs :-\n<\/p>\n<p>\t&#8220;Your<br \/>\n\tLordships may be pleased to issue a writ of mandamus or a writ in<br \/>\n\tthe nature of mandamus and\/or appropriate writ, order or direction<br \/>\n\tquashing and setting aside the impugned communication dated<br \/>\n\t03.03.2011 issued by respondent No.2 asking the petitioner to hand<br \/>\n\tover the possession of the land bearing Revenue Survey No.530\/1 of<br \/>\n\tthe petitioner situated at Mouje Sim of Anjar, Taluka Anjar,<br \/>\n\tDistrict Kutch, for the respondent No.3 for expansion of its Anjar<br \/>\n\tIndustrial Estate;\n<\/p>\n<p>\tPending<br \/>\n\tadmission and final disposal of the present petition, Your Lordships<br \/>\n\tmay be pleased to restrain the respondent Nos.1, 2 and 3 from taking<br \/>\n\tany further steps and\/or action for taking over possession of the<br \/>\n\tland of the petitioner bearing Revenue Survey No.530\/1 of the<br \/>\n\tpetitioner situated at Mouje Sim of Anjar, Taluka Anjar, District<br \/>\n\tKutch, for the respondent No.3 for expansion of its Anjar Industrial<br \/>\n\tEstate and further be pleased to restrain the respondent authorities<br \/>\n\tfrom taking any further action pursuant to the communication dated<br \/>\n\t03.03.2011 issued by the respondent No.2 in the interest of justice<br \/>\n\tand equity;&#8221;\n<\/p>\n<p>2.\t\tFor<br \/>\nthe same acquisition, earlier, the petitioner preferred Special Civil<br \/>\nApplication Nos.8827 to 8832 with Special Civil Application No.10612<br \/>\nto 10617 of 2008.  The said writ petitions came to be dismissed by<br \/>\nthe judgment and order dated 14.07.2009 &amp; 24.08.2009.  Against<br \/>\nthe said judgment, review application was preferred which was also<br \/>\ndisposed of on 10.09.2009.\n<\/p>\n<p>2.1\t\tAgainst<br \/>\nthe judgment of this Court dated 14.07.2009 &amp; 24.08.2009 passed<br \/>\nin Special Civil Application Nos.8827 to 8832 with Special Civil<br \/>\nApplication No.10612 to 10617 of 2008, the petitioners preferred<br \/>\nSpecial Leave to Appeal (Civil) Nos. 25754 to 25765 of 2009 before<br \/>\nthe Hon&#8217;ble Supreme Court and the same were also dismissed on<br \/>\n25.08.2010.  Thereafter, the petitioners preferred Review Application<br \/>\nas well as application for stay which are pending before the Hon&#8217;ble<br \/>\nSupreme Court.\n<\/p>\n<p>3.\t\tIn<br \/>\nthat view of the matter, the impugned order dated 03.03.2011 which<br \/>\ncame to be issued to the petitioners asking them to remain present on<br \/>\n01.04.2011 for handing over possession cannot be quashed as the<br \/>\nproceedings are already concluded.  In our view, the appropriate<br \/>\nremedy for the petitioner is to seek appropriate relief with regard<br \/>\nto the order dated 03.03.2011 before the Hon&#8217;ble Supreme Court in the<br \/>\npending review application.  Fresh writ petitions cannot be<br \/>\nentertained by this Court in view of the issue already concluded by<br \/>\nthe Division Bench of this Court as well as confirmed by the Hon&#8217;ble<br \/>\nSupreme Court.  Therefore, these petition cannot be entertained by<br \/>\nthis Court.  Hence, the present petitions stand dismissed.
