Justice HARUN-UL-RASHID\n\n Dated :27\/03\/2009\n\n O R D E R\n                           HARUN-UL-RASHID, J.\n                       ----------------------------------------\n                        W.P.(C) No.35780 of 2007\n                       ----------------------------------------\n                  Dated this the 27th day of March, 2009\n\n                                  JUDGMENT\n<\/pre>\n<p>            It is the case of the petitioner that he was a freedom fighter<\/p>\n<p>who had actively participated in the Punnapra-Vayalar movement during<\/p>\n<p>the freedom struggle. On account of his active participation in the said<\/p>\n<p>struggle, an arrest warrant was issued against him by the then Special<\/p>\n<p>Magistrate Court, Alleppey in case No.P.E. 7\/1122 ME and in order to<\/p>\n<p>evade the arrest, he had gone underground for a period of about 16<\/p>\n<p>months from 9.3.1122 ME to 11.7.1123 ME and as such he is entitled to<\/p>\n<p>get the benefit of&#8221;Swatantrata Sainik Samman pension&#8221; hereinafter referred<\/p>\n<p>to as the SSS Pension.\n<\/p>\n<p>       2.   The petitioner is a recipient of Kerala Freedom Fighter&#8217;s<\/p>\n<p>Pension (State Pension) .       Ext.P1 is the         proceedings of the District<\/p>\n<p>Collector dated 18.11.2006 granting state pension.<\/p>\n<p>       3.   Since the petitioner is getting the benefit of State Pension as<\/p>\n<p>per Ext.P1, he has also applied for the grant of SSS pension (Central<\/p>\n<p>Pension) as the Punnapra-Vayalar struggle was recognised as a part of the<\/p>\n<p>National Freedom Struggle with effect from 20.1.1998. Ext.P2 is the<\/p>\n<p>application dated 29.12.2006.\n<\/p>\n<p>       4.   Along with Ext.P2 application the petitioner has produced<\/p>\n<p>Ext.P3 affidavit dated 29.12.2006 duly attested by the Judicial 1st Class<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 35780 of 2007             -2-<\/span><\/p>\n<p>Magistrate Court, Alappuzha, Ext.P4 Non- availability of record Certificate<\/p>\n<p>from the Chief Judicial Magistrate, Alleppey         and Ext.P5     Personal<\/p>\n<p>knowledge Certificate issued by the freedom fighter Sri.H.K.Chakrapani<\/p>\n<p>who had undergone imprisonment in the Central Prison, Trivandrum for a<\/p>\n<p>period of more than 5 years and is also the recipient of SSS Pension as<\/p>\n<p>well as the holder of &#8220;Thamrapathra award&#8221;\n<\/p>\n<p>       5.    The Deputy Collector (General), Alappuzha           vide Ext.P6<\/p>\n<p>rejected the petitioner&#8217;s application for want of official records and did not<\/p>\n<p>forward it to the State Government. Subsequently the State Government<\/p>\n<p>issued another order No.1265\/FFP A2\/2007\/GAD dated 02.08.2008 which<\/p>\n<p>is produced as Ext.R2(a). In Ext.R2(a) it is stated that since the claim of<\/p>\n<p>the petitioner is    not recommended by the District Collector, the same<\/p>\n<p>cannot be recommended to the Central Government<\/p>\n<p>       6.    The documents referred above,are the relevant documents<\/p>\n<p>necessary for processing and recommending to the State and Central<\/p>\n<p>Governments The action on the part of the District Collector, Alappuzha is<\/p>\n<p>not justifiable.  The Non- availability of Records Certificate       and the<\/p>\n<p>Personal Knowledge Certificate      issued by the competent authority and<\/p>\n<p>eligible person respectively, are in accordance with clause 9(a) of the SSS<\/p>\n<p>Pension scheme, which are appended along with the petitioner&#8217;s<\/p>\n<p>application.\n<\/p>\n<p>       7.    In the result, Ext.P6 and Ext.R2 (a) are quashed. There will be<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 35780 of 2007             -3-<\/span><\/p>\n<p>direction  to the State Government to      send       the  verification cum<\/p>\n<p>entitlement to pension report along with their recommendation as enjoined<\/p>\n<p>under clause 10 of the SSS Pension Scheme within one month from the<\/p>\n<p>date of receipt of a copy of this judgment. On receipt of those documents<\/p>\n<p>the 1st respondent shall consider    and pass appropriate orders on Ext.P2<\/p>\n<p>within 2 months thereafter .
