His<br \/>\nappointment was for fixed time period and for fixed work. He<br \/>\napproached the Labour Court, Vadodara contending that he had<br \/>\ncompleted 307 days and respondent had terminated his services<br \/>\nillegally and violated the provisions of Section 25-F, G and H of the<br \/>\nAct. The Labour Court passed the award granting permanency.\n<\/p>\n<p>3.\tThough<br \/>\nserved, none appears for the respondent. Heard the learned Advocate<br \/>\nfor the petitioner and perused the relevant documents on record.<br \/>\nHaving considered the submissions and perused the record of the case,<br \/>\nit transpires that the issue involved in the present case is squarely<br \/>\ncovered by a Full Bench decision of this Court in the case of Amreli<br \/>\nMunicipality V. G.P.M.E. Union, reported in 2004(3) GLR  1841. The<br \/>\nratio laid down  in the said decision reads as under:\n<\/p>\n<p>&#8220;12.1\tAfter<br \/>\nconsidering the decisions cited before us, the following principles<br \/>\nemerge:\n<\/p>\n<p>[A]\tNo<br \/>\nregularization or permanency can be effected de hors the statutory<br \/>\nprovisions or the guidelines.\n<\/p>\n<p>[B]\tLong<br \/>\nservice put in by the workmen itself may not be a ground to<br \/>\nregularize services of ad hoc\/temporary workmen against the<br \/>\nsanctioned set-up without following statutory procedure of<br \/>\nrecruitment. At the most, Labour Court\/Industrial Tribunal can issue<br \/>\ndirection fro consideration of absorption subject to availability of<br \/>\nposts on the establishment.\n<\/p>\n<p>[C]\tTo<br \/>\navoid nepotism and corruption, no back-door entry in service;\n<\/p>\n<p>[D]\tFinancial<br \/>\ncapacity of the local body to have additional burden is a relevant<br \/>\nconsideration to be kept in mind while ordering regularization or<br \/>\nabsorption.&#8221;\n<\/p>\n<p>4.\tThis<br \/>\nCourt further observed therein that the Apex Court, in no uncertain<br \/>\nterms, ruled that the Labour Court\/Industrial Tribunal can neither<br \/>\nregularize services of a workman nor grant permanency when his<br \/>\ninitial appointment itself de hors the rules or not on the sanctioned<br \/>\npost and has deprecated orders of the High Court\/Labour<br \/>\nCourts\/Tribunals directing to regularize services of not legally<br \/>\nrecruited persons and has  given guidelines.\n<\/p>\n<p>5.\tThe<br \/>\nLabour Court has not considered the ratio laid down in the aforesaid<br \/>\ndecision. Therefore the matter is required to be remanded to the<br \/>\nLabour Court.\n<\/p>\n<p>6.\tAccordingly<br \/>\nthe judgement and award impugned in the present petition is quashed<br \/>\nand set aside. Matter is remanded to the Labour Court for<br \/>\nconsideration afresh in light of the decision in the case of  Amreli<br \/>\nMunicipality (supra). Such decision shall be taken within a period of<br \/>\ntwo years from the date of receipt of writ of this court. It is<br \/>\nclarified that this Court has not expressed any opinion on merits of<br \/>\nthe matter.
