Justice T.R.RAMACHANDRAN NAIR\n\n Dated :16\/01\/2009\n\n O R D E R\n              T.R.RAMACHANDRAN NAIR,J.\n                      -------------------------\n                W.P ( C) No. 36223 of 2005\n                     --------------------------\n             Dated this the 16th January,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      Aggrieved by the order of suspension Ext.P1,the<\/p>\n<p>petitioner approached this Court by filing this writ<\/p>\n<p>petition.  According to the petitioner, she had filed a<\/p>\n<p>complaint against respondents 7 to 9 with regard to<\/p>\n<p>certain matters.  But the petitioner had to suffer     the<\/p>\n<p>order of suspension unnecessarily.<\/p>\n<p>      2.  In the counter affidavit filed by respondents 1<\/p>\n<p>to 5, it has been made clear in paragraph 13 that the<\/p>\n<p>petitioner has been re-instated in service and posted as<\/p>\n<p>Senior Lecturer (DIET) in Thrissur against the retirement<\/p>\n<p>vacancy of one Smt.Kochuthressia. Therefore, as far the<\/p>\n<p>revocation of suspension is concerned the matter has<\/p>\n<p>become final.\n<\/p>\n<p>      3.   The surviving grievance is regarding the non-<\/p>\n<p>payment of salary. It is made clear by respondents in para<\/p>\n<p>13 of the counter that since no special rules have been<\/p>\n<p>W.P ( C) No. 36223 of 2005<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>framed for      DIET Institutions and the appointment as<\/p>\n<p>Lecturer in DIET is on provisional basis. Accordingly, the<\/p>\n<p>5th respondent Accountant General (A&amp;E) has issued<\/p>\n<p>provisional pay slip to DIET staff. It is pointed out that<\/p>\n<p>presumably because of the pendency of the writ petition<\/p>\n<p>she was not issued pay slip as was being issued to other<\/p>\n<p>staff members.\n<\/p>\n<p>      4.
