Justice R.BASANT\n\n Dated :18\/10\/2007\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                     Crl.M.C.No.3208 of 2007\n                    ----------------------------------------\n              Dated this the 18th day of October 2007\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for offence<\/p>\n<p>punishable under Section 138 of the Negotiable Instruments Act.<\/p>\n<p>Cognizance was taken as early as in 2003. The petitioner had<\/p>\n<p>entered appearance.           He was enlarged on bail.                   But<\/p>\n<p>subsequently, consequent to his non-appearance, warrant of<\/p>\n<p>arrest has been issued by the learned Magistrate against the<\/p>\n<p>petitioner and the case against him has been transferred to the<\/p>\n<p>list of long pending cases.\n<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence was not wilful or deliberate. The                 petitioner   is<\/p>\n<p>willing to surrender before the learned Magistrate and seek<\/p>\n<p>regular bail. But he apprehends that his application for bail may<\/p>\n<p>not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously.                   He, therefore, prays<\/p>\n<p>that directions under Section 482 Cr.P.C. may be issued to the<\/p>\n<p>learned Magistrate to release the petitioner on bail when he<\/p>\n<p>appears and applies for bail.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3208\/07                 2<\/span><\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate.      I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>for bail to be filed by the petitioner on merits, in accordance with<\/p>\n<p>law and expeditiously.      Every court must do the same.       No<\/p>\n<p>special or specific directions appear to be necessary. Sufficient<\/p>\n<p>general directions have been issued in <a href=\"\/doc\/147290035\/\">Alice George vs. Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1)KLT 339].<\/p>\n<p>      4.
