Learned advocate for the<br \/>\npetitioners submitted that the relatives of the petitioners have<br \/>\ntried to take custody of the girl and therefore they have made   an<br \/>\napplication to the respondent No.2 &#8211; Police Inspector, Visnagar<br \/>\nPolice Station but no action has been taken by respondent No.2.<br \/>\nLearned advocate Mr.Brahmbhatt has relied upon the decision of  the<br \/>\nHon&#8217;ble Supreme Court in the case of Lata Singh vs. State of U.P.<br \/>\n&amp; Anr., reported in AIR 2006 SC 2522, more particularly, in<br \/>\nparagraphs 18 and 19 which reads as under:\n<\/p>\n<p>&#8220;18.\tWe<br \/>\nsometimes hear of &#8216;honour&#8217; killings of such persons who undergo<br \/>\ninter-caste or inter-religious marriage of their own free will. There<br \/>\nis nothing honourable in such killings, and in fact they are nothing<br \/>\nbut barbaric and shameful acts of murder committed by brutal, feudal<br \/>\nminded persons who deserve harsh punishment. Only in this way can we<br \/>\nstamp out such acts of barbarism.\n<\/p>\n<p>19.\tIn the<br \/>\ncircumstances, the writ petition is allowed. The proceedings in<br \/>\nSessions Trial No.1201\/2001 titled State of U.P. v. Sangita Gupta &amp;<br \/>\nOrs. arising out of FIR No.336\/2000 registered at Police Station<br \/>\nSarojini Nagar, Lucknow and pending in the Fast Track Court V.<br \/>\nLucknow are quashed. The warrants against the accused are also<br \/>\nquashed. The police at all the concerned places should ensure that<br \/>\nneither the petitioner nor her husband nor any relatives of the<br \/>\npetitioner&#8217;s husband are harassed or threatened nor any acts of<br \/>\nviolence are committed against them. If anybody is found doing so, he<br \/>\nshould be proceeded against sternly in accordance with law, by the<br \/>\nauthorities concerned.&#8221;\n<\/p>\n<p>3.\tIt<br \/>\nis an admitted fact that till today no complaint is lodged by the<br \/>\nfather of the victim against the petitioners.   No complaint is<br \/>\nplaced on record which shows that the petitioners have made any<br \/>\napplication before the police for taking appropriate steps for their<br \/>\nprotection.  Except bare words and showing the copy of Registered<br \/>\nPost A.D. Slip, nothing is placed on record of the case. In these<br \/>\nfacts and circumstances of the case, the petitioners are directed to<br \/>\nsubmit an  application before the District Suptd. Of Police, Mehsana\n<\/p>\n<p>&#8211; respondent No.1 herein, and if such an application is<br \/>\npreferred  by the present petitioners, then the respondent No.1 &#8211;<br \/>\nDSP, Mehsana will look into the matter and  take appropriate steps in<br \/>\nthe matter.\n<\/p>\n<p>4.\tWith<br \/>\nthe above direction, this petition is disposed of.
