SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/08\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Shri Poonam Gadhvi, wavies service of notice of admission on behalf<br \/>\nof the respondent. With the consent of the parties, the matter is<br \/>\ntaken up for final hearing today.\n<\/p>\n<p>2.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner-original defendant has prayed for an appropriate writ,<br \/>\ndirection and \/ or order quashing and setting aside the impugned<br \/>\norder dated 13.12.2007 passed by the learned Chamber Judge, Court No.<br \/>\n5, City Civil Court, Ahmedabad below Exh. 19 in Summary Suit No. 113<br \/>\nof 2004, by which the learned City Civil Court has granted<br \/>\nconditional leave to the petitioner to defend the suit on deposit of<br \/>\nRs. 1 lacs.\n<\/p>\n<p>3.\tIt<br \/>\nappears that the suit has been filed for recovery of Rs. 7,22,110\/-<br \/>\nand summons for judgment was taken by the plaintiff and the defendant<br \/>\nsubmitted application for leave to defend by submitting that suit is<br \/>\nbarred by limitation and number of contentions \/ triable issues were<br \/>\nraised by the petitioner-defendant. The learned City Civil Court<br \/>\ngranted leave to defend to the petitioner on condition to deposit Rs.<br \/>\n1 lacs.\n<\/p>\n<p>4.\tShri<br \/>\nA.R. Bhatt, learned advocate for the petitioner has submitted that in<br \/>\nthe facts and circumstances of the case, more particularly, when<br \/>\nthere are number of triable issues raised by the petitioner inclusive<br \/>\nof suit being barred by limitation, the learned City Civil Court<br \/>\nought to have granted conditional leave to defend to the petitioner<br \/>\nto defend the aforesaid suit.\n<\/p>\n<p>5.\tShri<br \/>\nPoonam Gadhvi, learned advocate for the respondent-original plaintiff<br \/>\nhas submitted that when the learned City Civil Court has exercised<br \/>\nthe discretion granting  conditional leave to defend to the<br \/>\npetitioner to defend the suit on condition to deposit of Rs. 1 lacs<br \/>\nonly against the claim of Rs. 7,22,110\/-, the same is not required to<br \/>\nbe interfered in exercise of powers under Article 227 of the<br \/>\nConstitution of India.\n<\/p>\n<p>\t6.Having<br \/>\nheard the learned advocate for the respective parties and considering<br \/>\nthe application for leave to defend and the impugned order, it<br \/>\nappears to the Court that there are number of triable issues raised<br \/>\nby the petitioner including the suit being barred by limitation.<br \/>\nConsidering the decision of the  Hon&#8217;ble Apex Court in the case of<br \/>\nM\/s. Mechalec Engineers &amp; Manufactures Vs. Basic Equipment<br \/>\nCorporation reported in AIR 1977 SC 577 the learned City Civil Court<br \/>\nought to have granted unconditional leave to defend to the petitioner<br \/>\nto defend the suit. Under the circumstances, the impugned order<br \/>\npassed by the learned City Civil Court by which the trial Court has<br \/>\ndirected the petitioner to deposit of Rs. 1 lacs while granting the<br \/>\nconditional leave to defend is requires to be quashed and set aside.\n<\/p>\n<p>7.\tFor<br \/>\nthe reasons stated above, petition succeed, impugned order passed by<br \/>\nthe learned Chamber Judge, City Civil Court, Ahmedabad dated<br \/>\n13.12.2007 passed below Exh. 19 in Summary Suit No. 113 of 2004, by<br \/>\nwhich the petitioner is directed to deposit Rs. 1 lac while granting<br \/>\nthe conditional leave to defend is hereby quashed and set aside and<br \/>\nthe petitioner is granted unconditional leave to defend the aforesaid<br \/>\nSummary Suit No. 113 of 2004. Rule is made absolute.
