Heard learned counsel appearing on behalf<\/p>\n<p>                   of the petitioner and learned counsel appearing on<\/p>\n<p>                   behalf of the State.\n<\/p>\n<p>                             This is a case of misuse of privilege of<\/p>\n<p>                   bail. The petitioner is in custody in connection<\/p>\n<p>                   with Kotwali P.S. Case No.209 of 2008 for the<\/p>\n<p>                   offence punishable under section 387, 324, 307,<\/p>\n<p>                   120B\/34 of the Indian Penal Code and section 3\/4<\/p>\n<p>                   of the Explosive Substance Act.\n<\/p>\n<p>                             The   petitioner    was   granted      bail   in   the<\/p>\n<p>                   said case vide order dated 21.10.2008 and as he<\/p>\n<p>                   was in custody in connection with Kotwali P.S.Case<\/p>\n<p>                   No.258 of 2008, hence he could not be released.<\/p>\n<p>                   The    petitioner     was    granted      bail    in    Kotwali<\/p>\n<p>                   P.S.Case No.258 of 2008 on 1.5.2009.<\/p>\n<p>                             Learned counsel for the petitioner submits<\/p>\n<p>                   that   due   to   communication     gap,    the    petitioner<\/p>\n<p>                   could not present himself on the due dates despite<\/p>\n<p>                   the bail having been granted on 21.10.2008 in the<\/p>\n<p>                   present case and as a consequence whereof, his<\/p>\n<p>                   bail bonds were cancelled on 19.1.2009 while he<\/p>\n<p>                   was in custody in the second case. The petitioner<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>      had    subsequently          surrendered         on      4.3.2010      and<\/p>\n<p>      undertakes to abide by the stipulations allowed by<\/p>\n<p>      this court for consideration of bail.<\/p>\n<pre>                  Having        regard          to     the         submissions\n\n      aforesaid,     let        the   petitioner         Md.      Hasan    Ahmad\n\n<\/pre>\n<p>      alias Mintoo be released on furnishing bail bond<\/p>\n<p>      of Rs.10,000\/-(ten thousand) with two sureties of<\/p>\n<p>      the like amount each to the satisfaction of the<\/p>\n<p>      Additional District Judge, F.T.C.III, Bhagalpur in<\/p>\n<p>      connection      with       Sessions       Case     No.458      of     2010<\/p>\n<p>      arising     from     Kotwali        P.S.Case        No.209      of    2008<\/p>\n<p>      (G.R.No.959 of 2008), subject to the conditions<\/p>\n<p>      that the petitioner would be attending the trial<\/p>\n<p>      of    the   case     on    each    and     every      date    fixed   and<\/p>\n<p>      failure on his part to attend the trial on two<\/p>\n<p>      consecutive          dates        fixed        without       reasonable<\/p>\n<p>      explanation        to     the     satisfaction         of    the     trial<\/p>\n<p>      court, would confer liberty to the court concerned<\/p>\n<p>      to initiate proceedings for cancellation of his<\/p>\n<p>      bail bond and for taking him into custody.<\/p>\n<pre>ahk                            (Jyoti Saran, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Hasan Ahmad @ Mintoo vs State Of Bihar on 17 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
