 By  and award, the Tribunal has

 tra4f\ufb01.CV”‘aCoident. Being aggrieved by the said judgment<\/p>\n
0’  Gianni ayvard, the appellant has presented this appeal<\/p>\n
seeking enhancement on the ground that, the amount<\/p>\n
0 awarded by the Tribunal is inadequate.<\/p>\n
3. In brief, the fags of the case are as follows :<\/p>\n

The appellant claims to be aged about 19 years,
\nworking as Assistant in Gurjari shop, getting salary of<\/p>\n
?2100\/– p.I’I1. He was hale and healthy prior ‘tloiegthe<\/p>\n
accident. That, at about 9 pm. on 7 <\/p>\n
was proceeding in a Hero puch Vehicle~be:arir1g: Regri.~.. <\/p>\n
No.KA.O2\/K\/ 8582, as a pillion  <\/p>\n
Kantha, slowly and cautiously, ontiie    <\/p>\n
road from Kaiikamba temple-.,:_toyvards\u00ab.,l$E’andia circle,
\nnear over bridge,     tractor bearing
\nRegn.No.KA.i  its driver in<\/p>\n
high lspeedll negligent manner, came from
\nNandalcircle   the Hero puch. Due to<\/p>\n
Whi_fclh,zthe  fell down and sustained injuries<\/p>\n
  _Vas.gfraeture of right thigh, injury to the left knee,<\/p>\n
 \ufb01ght  ttgtit forearm, forehead, left rib and other<\/p>\n
parts  the body. Immediately, he was admitted to<\/p>\n
  Cte-nerai hospital, Mandya, where he has taken<\/p>\n
lltreatnient for about 40 days as inpatient and undergone<\/p>\n
Wtwo surgeries. The doctor has assessed the physical<\/p>\n
disability at 50%. Or1e~third of it would be 16.66%<\/p>\n
rounded of to 17% towards whole body disability. It is<\/p>\n

the further case of the appellant that due to the injuries<\/p>\n
sustained by him in the accident, he has suffered\u00bb-.1_ot of<\/p>\n
pain and suffering and spent considerable<\/p>\n
towards medical expenses, conveyance, nourisiiing  <\/p>\n
and attendant charges. He has ;to”Vst1’f3Fer’–.pth.e <\/p>\n
and unhappiness caused   <\/p>\n

 after  both sides and after assessing the<\/p>\n
   -documentary evidence, has allowed the said<\/p>\n
  part and awarded a sum of ?-43,700\/-<\/p>\n
as.u’co1npensation under different heads with interest at<\/p>\n

Airetaiisation. Being aggrieved by the said judgment and<\/p>\n
“award, the appellant has presented this appeal, seeking<\/p>\n
enhancement of compensation.\n<\/p>\n

4. We have heard the learned counsel for the<\/p>\n
appellant and the learned counsel for the second<\/p>\n
respondent–insurer.\n<\/p>\n
5. After careful perusal of the material availabieplon<\/p>\n
record and the impugned judgement and <\/p>\n
emerges is that, the ‘i’ribunalj’has” awfarded’<\/p>\n
reasonable compensation towards medical’, _ex’pvense.s;–~ as . 2<\/p>\n
per the medical bills produced by the andll<\/p>\n
therefore, we do not ‘i1iterferel_with the same. However,
\nthe Tribunal has not  reasonable<\/p>\n
comp7ensatio’r:’.t.a_w’ards_apa,in and sufferings, conveyance.
\nnourishing\u00bb food “ar1dv.””attendant charges and ioss of<\/p>\n
incorne. duringplilaidi up period. Further, it has not<\/p>\n
. awai\ufb02ed any compensation towards loss of amenities,<\/p>\n
‘ ‘discon1forts”a’nd unhappiness and loss of future income.<\/p>\n
There’vis”no dispute regarding the Occurrence of the<\/p>\n
 Apaccident, the negligence of the driver of the vehicle.<\/p>\n
Aplrelslultant injuries and the treatment taken as inpatient<\/p>\n
‘Min the hospital and the surgeries underwent by the<\/p>\n
appellant. Further, there is also no dispute regarding
\nthe occupation and the income of the appellant. The<\/p>\n

\nappellant has taken treatment for a period of 40 days<\/p>\n
and the doctor has assessed the physical disability at<\/p>\n
50% and if one–third of it is taken, the whoglemlbody<\/p>\n
disability comes to 16.66%, rounded of _<\/p>\n
presume that he might have talten V. <\/p>\n
and bed rest for a period of four  <\/p>\n
have undergone pain and ag’o.ny and ‘spent:’considerable.it*<\/p>\n
amount towards conveyance-,\u00bb,_ nourishing food and
\nattendant charges  tireatinent  period and on
\naccount of the”injuries”and he_”rr_1ay’. ngotxbe in a position<\/p>\n
to discharge effectively as he was Carrying
\nout prior\ufb02lto the  The appellant has to suffer<\/p>\n
th,e_seV discornforts throughout his life. However, these<\/p>\n
\u00bb :aspectsA\u00ab.o–f:the matter have neither been looked into by<\/p>\n
H nor considered nor awarded just and<\/p>\n
reasonable compensation.\n<\/p>\n
 Having regard to the facts and circumstances of<\/p>\n
lithe case as stated above, we deem it proper to award<\/p>\n

The second  directed to
\ndeposit the   H ,3 1,512\/– with
\ninterest at  date of petition till the date
\nof realisationtdwithiin  from the date of receipt<\/p>\n
of  copy of  judgment and award.\n<\/p>\n
‘A ‘ V.  the enhanced compensation of ?1,31,512\/–<\/p>\n
  — with proportionate interest shall<\/p>\n
 in Fixed Deposit :11 any Nationalized or<\/p>\n
