No.24737 of 2011\n                                 Sanjay Yadav sonof late Bharat Yadav\n                                                 Versus\n                                         The State Of Bihar\n                                               -----------\n<\/pre>\n<p>3.   19.9.2011               Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                             The petitioner is apprehending his arrest in a case<\/p>\n<p>                 registered under Sections 341, 323, 504 of the Indian Penal<\/p>\n<p>                 Code and 3(i)(x) of the Scheduled Caste and Scheduled Tribe<\/p>\n<p>                 (Prevention of Atrocities) Act.\n<\/p>\n<p>                            Considering the nature of allegations, let the<\/p>\n<p>                 petitioner above named be released on anticipatory bail in the<\/p>\n<p>                 event of arrest or surrender before the learned court below<\/p>\n<p>                 within a period of 12 weeks from today in connection with<\/p>\n<p>                 Murar P.S. case No.59 of 2010 on furnishing bail bonds of<\/p>\n<p>                 Rs.10,000\/- (Ten thousand) with two sureties of the like<\/p>\n<p>                 amount each to the satisfaction of the Chief Judicial<\/p>\n<p>                 Magistrate, Buxar, subject to the conditions as laid down<\/p>\n<p>                 under Section 438(2) of the Code of Criminal Procedure as<\/p>\n<p>                 also conditions (i) That one of the bailor will be a close relative<\/p>\n<p>                 of the petitioner who will give an affidavit giving genealogy as<\/p>\n<p>                 to how he is related with the petitioner. The bailor will<\/p>\n<p>                 undertake to furnish information to the Court about any<\/p>\n<p>                 change in address of the petitioner. (ii) That the affidavit shall<\/p>\n<p>                 clearly state that the petitioner is not an accused in any other<\/p>\n<p>                 case and if he is he shall not be released on bail, (iii) That the<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            bailor shall also state on affidavit that he will inform the court<\/p>\n<p>            concerned if the petitioner is implicated in any other case of<\/p>\n<p>            similar nature after his release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse, (iv)<\/p>\n<p>            That the petitioner will give an undertaking that he will receive<\/p>\n<p>            the police papers on the given date and be present on date<\/p>\n<p>            fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>            delays the trial in any manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse, (v) That the petitioner will be<\/p>\n<p>            well represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                       ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sanjay Yadav vs The State Of Bihar on 19 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
