Sessions<br \/>\n\tJudge has held the appellant   accused guilty for the offences<br \/>\n\tpunishable under Sections 8(C), 20(B), II(B), 22 and 29 of the<br \/>\n\tNarcotic Drugs and Psychotropic Substance Act, 1985 (for short  NDPS<br \/>\n\tAct ) and sentenced him to suffer Rigorous Imprisonment for 5<br \/>\n\tyears and to pay fine of Rs.30,000\/- i\/d to further undergo SI for<br \/>\n\tsix months.\n<\/p>\n<p>The<br \/>\n\tbrief facts of the case of prosecution are that on 28.6.2005 at<br \/>\n\tnight combing the Police Inspector Shri R.V. Rabari and his staff<br \/>\n\treceived the information that in the morning at about 8.00 A.M., one<br \/>\n\tperson, named, Somnath, wearing Kesari colour Jabbha and Dhoti, is<br \/>\n\treaching near Soni&#8217;s Chawl Char Rasta, Odhav, Ahmedabad with large<br \/>\n\tquantity of Ganja. On receipt of such information P.I. Rabari made<br \/>\n\tthe entry in Station Diary and also informed his superior officer<br \/>\n\tand thereafter he called the two panchas. The first part of the<br \/>\n\tpanchnama was prepared by the P.I. Thereafter the Police Inspector,<br \/>\n\talong with the Staff and the Panchas, reached the place and kept<br \/>\n\twatch. Thereafter, after about half an hour one person came who was<br \/>\n\tstopped by the raiding party and on interrogation the said person<br \/>\n\twas found with contraband articles. The police seized the said<br \/>\n\tarticle Ganja and the sample was sent for analysis. Thereafter the<br \/>\n\toffence under the provisions of the NPDS Act was registered against<br \/>\n\tthe appellant   accused.\n<\/p>\n<p>Necessary<br \/>\n\tinvestigation was carried out by the Police. Offence under Sections<br \/>\n\t8(C), 20(B), II(B), 22 and 29 of NDPS Act was registered against the<br \/>\n\taccused. The statements of the witnesses were recorded.  Thereafter,<br \/>\n\tafter completion of investigation the charge-sheet against the<br \/>\n\taccused came to be submitted before the Court. The learned<br \/>\n\tAdditional Sessions Judge framed the charge against the accused. The<br \/>\n\taccused pleaded not guilty to the charge and claimed to be tried.\n<\/p>\n<p>To<br \/>\n\tprove the case against the accused, the prosecution has examined the<br \/>\n\twitnesses and also relied upon documentary evidence and at the end<br \/>\n\tof trial, after recording the statement of the accused under Section<br \/>\n\t313 Cr. P.C., and after hearing the arguments on behalf of the<br \/>\n\tprosecution and the defence, the learned Sessions Judge held the<br \/>\n\tappellant  (original accused) guilty of the offence charged against<br \/>\n\thim and awarded the sentence as narrated herein above.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the aforesaid Judgment and order<br \/>\n\tof conviction and sentence the appellant   accused has preferred<br \/>\n\tthis Appeal.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate Mr. P.K. Shukla, appearing on behalf of the<br \/>\n\tappellant   accused and learned APP Mr. H.L. Jani, on behalf of<br \/>\n\tthe respondent   State. I have gone through the Judgment and order<br \/>\n\tpassed by the trial Court. I have also considered the documents<br \/>\n\tproduced on the record of the case.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate, appearing on behalf of the appellant   accused, has<br \/>\n\tcontended that the appellant   accused has not committed any<br \/>\n\toffence as alleged in the charge. He has contended that looking to<br \/>\n\tthe oral as well as documentary evidence of the witness has not<br \/>\n\tcommitted the offence alleged against him. He has contended that<br \/>\n\tthere are serious contradictions in the  oral evidence of the<br \/>\n\twitness. Learned Advocate has also contended that the accused has<br \/>\n\talready undergone the sentence of five years awarded by the learned<br \/>\n\tAdditional Sessions Judge. He has contended that the learned Judge<br \/>\n\thas also ordered to pay fine of Rs.30,000\/- and in default of fine<br \/>\n\tthe appellant   accused should suffer SI for six months  and at<br \/>\n\tpresent the appellant   accused is undergoing the sentence awarded<br \/>\n\tby the learned Additional Sessions Judge in default of fine which<br \/>\n\talso the appellant has already undergone for more than a period of 3<br \/>\n\tmonths. The learned Advocate, therefore, contended that looking to<br \/>\n\tthe poor condition of the accused he is not in a position to pay the<br \/>\n\tfine and when he has already undergone the sentence awarded by the<br \/>\n\tlearned Judge,  therefore, some leniency may be shown towards the<br \/>\n\tappellant   accused.\n<\/p>\n<p>Learned<br \/>\n\tAPP has supported the Judgment and order passed by the learned<br \/>\n\tSessions Judge and contended that looking to the seriousness of<br \/>\n\toffence no interference of this Court is called for. He has<br \/>\n\tcontended that looking to the facts and evidence on records the<br \/>\n\tlearned Judge has rightly held the accused guilty for the offence<br \/>\n\talleged against him and, therefore, no interference is called for.\n<\/p>\n<p>I<br \/>\n\thave gone through the Judgment and order passed by the learned<br \/>\n\tAdditional Sessions Judge and also gone through the documents<br \/>\n\tproduced before me. I have also considered the submissions made by<br \/>\n\tthe learned Advocates for the parties. The learned APP has also<br \/>\n\tproduced the jail record of the appellant   accused  which shows<br \/>\n\tthat the appellant = accused has alrready undergone the sentence of<br \/>\n\t5 years, 2 months and 3 days. The said Report is of 31.8.2010, that<br \/>\n\tmeans the appellant has completed the sentence of more than 5 years<br \/>\n\tand three months. From the evidence on record it clearly appears<br \/>\n\tthat the learned Judge has not committed any error in holding the<br \/>\n\tappellant   accused guilty for the offences charged against him.<br \/>\n\tHowever, looking to the facts and circumstances of the case, in my<br \/>\n\topinion, the sentence, in default of non-payment of fine, is<br \/>\n\trequired to be reduced.  The learned Advocate appearing on behalf of<br \/>\n\tthe appellant has also not argued the matter seriously on merit and<br \/>\n\tcontended that the appellant   accused is an illiterate and poor<br \/>\n\tperson and he is the bread-winner of the family and, therefore, some<br \/>\n\tleniency may be shown. Looking to the facts of the case if the<br \/>\n\tsentence for non-payment of fine awarded by the learned Addl.<br \/>\n\tSessions Judge is reduced to 3 months, instead of 6 months, as<br \/>\n\tordered by the learned Judge,  the same would serve the ends of<br \/>\n\tjustice.\n<\/p>\n<p>In<br \/>\n\tview of above, the Appeal is partly allowed. The Judgment and order<br \/>\n\tof conviction dated 11.8.2006, awarding substantive sentence passed<br \/>\n\tby the learned Additional Sessions Judge, Court No.18, Ahmedabad, in<br \/>\n\tSessions Case No.262 of 2006 convicting the appellant   accused<br \/>\n\tfor the offence under Sections 8(C), 20(b), II(b), 22 and 29 of the<br \/>\n\tNDPS Act is hereby confirmed. However, the order of sentence to pay<br \/>\n\tfine of Rs.30,000\/- i\/d to undergo SI for 6 months is altered and<br \/>\n\treduced to the effect that in default of payment of fine the<br \/>\n\tappellant   accused shall undergo SI for three months, instead of<br \/>\n\tSI for six months as ordered by the learned additional Sessions<br \/>\n\tJudge. The appellant   accused has already undergone the sentence<br \/>\n\tand, therefore, he shall be set at liberty forthwith if he is not<br \/>\n\trequired to be detained in any other case.
