LTD. - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nPH PATHAK for\nPetitioner(s) : 1, \nMR ASHISH M DAGLI for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n\t\n       Date : 20\/08\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this application, the applicant has prayed to direct the<br \/>\nrespondent to pay full salary from the date of award till 14.09.2004<br \/>\nand wages as per Section 17B of the I.D. Act.\n<\/p>\n<p>2.\t\tThe<br \/>\nshort facts of the case are that the applicant herein is the original<br \/>\nrespondent in the captioned petition. The award of the Labour Court<br \/>\ndirecting the respondent to reinstate the applicant in service is not<br \/>\ncomplied with the respondent and therefore the applicant has<br \/>\npreferred this application for wages u\/s. 17B of the I.D. Act.\n<\/p>\n<p>3.\t\tMr.\n<\/p>\n<p>Pathak, learned counsel for the applicant has contended that the<br \/>\napplicant is not gainfully employed and therefore, he is entitled for<br \/>\nwages u\/s. 17B of the ID Act. He has further contended that there is<br \/>\nno necessity of stay against the reinstatement even though provisions<br \/>\nof Section 17B of the I.D. Act are applicable. In support of his<br \/>\nsubmission, he has placed reliance upon the decision of this Court in<br \/>\nthe case of A.P.M.C. v.  P.B. Dave reported in 2008(1) GLR  568,<br \/>\nwherein the Court in para 12 has observed as under :-\n<\/p>\n<p>12.\t\tAfter<br \/>\ngoing through the entire Section, I am not able to find out that<br \/>\nreinstatement must have to be stayed being a condition precedent for<br \/>\ngranting benefit of Section 17B of ID Act, 1947. There is no need to<br \/>\nhave the stay against reinstatement, even in absence of the stay,<br \/>\nmerely, award of reinstatement, if challenged by employer, prefers<br \/>\nany proceedings against such award in High Court, then, during the<br \/>\nperiod of pendency, workman is entitled the benefit of Section 17B of<br \/>\nIndustrial Disputes Act, 1947.\n<\/p>\n<p>4.\t\tSimilar<br \/>\nprinciple has been laid down in the decision of this Court  reported<br \/>\nin 2004(3) GLH 375.\n<\/p>\n<p>5.\t\tMr.\n<\/p>\n<p>Dagli, learned counsel for the respondent has contended that the<br \/>\napplicant is engaged in the business of construction and also<br \/>\npossessed Indigo car.  Therefore, he is not entitled for the benefits<br \/>\nu\/s. 17B of the I.D. Act.\n<\/p>\n<p>6.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record.   From the record it appears that this Court had not<br \/>\nstayed the impugned award passed by the Labour Court.   Therefore,<br \/>\nthe applicant is not entitled for wages u\/s. 17B of te I.D. Act.<br \/>\nPrima facie, it<br \/>\nappears that the applicant has not gone to resume the duties and<br \/>\ntherefore,  it is clear that  the applicant is not willing to work,<br \/>\nthough the respondent had offered work.  From the reply filed by the<br \/>\nrespondent, it is clear that<br \/>\nthe applicant was gainfully employed and he possessed a Indigo car.<br \/>\nMoreover the affidavit filed by the applicant is bogus inasmuch<br \/>\nhe possessed a bungalow and Indigo car.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of the above, the application is rejected with costs of<br \/>\nRs.500\/-, which shall be payable to the respondent.\n<\/p>\n<p>[K.S.\n<\/p>\n<p>JHAVERI, J.]<\/p>\n<p>\/phalguni\/<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Rauf vs Pragati on 20 August, 2010 Author: Ks Jhaveri,&amp;Nbsp;
