PATTANAIK (J)\n\nCITATION:\n JT 1996 (3)   556\t  1996 SCALE  (3)8\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     We have  heard learned counsel on all sides even at the<br \/>\nadmission stage.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal by special leave arises from the order made<br \/>\non 29.2.1996  in  Writ\tPetition  No.2453\/95  by  the  third<br \/>\nlearned Judge  of the  High Court  of Delhi  whom matter was<br \/>\nreferred pursuant  to the difference of opinion expressed by<br \/>\na Division  Bench of  the High\tCourt in  the  orders  dated<br \/>\nDecember 6,  1995. The\tlearned Judge agreed with one of the<br \/>\ntwo learned  Judges and\t held that  the appellant, nominated<br \/>\nunder Section  4(e) of\tthe All\t India Institute  of Medical<br \/>\nSciences [AIIMS]  Act [25  of 1956]  [for short, the &#8216;Act&#8217;],<br \/>\nnot being  a  scientist\t &#8211;  either  medical  or\t non-medical<br \/>\nrepresenting the Indian Science Congress Association, is not<br \/>\na person  within the  meaning of that section; he thus being<br \/>\nnot entitled  to be nominated, his nomination is bad in law.<br \/>\nThe question  that arises  is: whether in the composition of<br \/>\nmembers\t indicated  in\tSection\t 4  of\tthe  Act  comprising<br \/>\ndifferent interests  [of  which\t category  of  five  persons<br \/>\nenumerated in  clause (e)  thereof], all the five per should<br \/>\nbe Scientists,\teither medical\tor non-medical, representing<br \/>\nthe Indian  Science Congress  Association or only  ors among<br \/>\nthem should  be a  non-medical\tscientist  representing\t the<br \/>\nIndian Science\tCongress Association  and rest four be other<br \/>\nthan the medical or non-medical scientists category? Section<br \/>\n4 deals thus:\n<\/p>\n<blockquote><p>     &#8220;Composition of the Institute ;<br \/>\n     The Institute  shall consist of the<br \/>\n     following members, namely:-\n<\/p><\/blockquote>\n<blockquote><p>     (a)  The\tVice-Chancellor\t of  the<br \/>\n     Delhi University, ex-officio;\n<\/p><\/blockquote>\n<blockquote><p>     (b) The  Director-General of Health<br \/>\n     Services, Government  of India, ex-<br \/>\n     officio;\n<\/p><\/blockquote>\n<blockquote><p>     (c) The  Director of the Institute,<br \/>\n     ex-officio;\n<\/p><\/blockquote>\n<blockquote><p>     (d)  Two\trepresentatives\t of  the<br \/>\n     Central Government, to be nominated<br \/>\n     by the  Government,  one  from  the<br \/>\n     Ministry of  Finance and  one  from<br \/>\n     the Ministry of Education;<\/p><\/blockquote>\n<blockquote><p>     (e) Five  persons of whom one shall<br \/>\n     be\t  a    non-medical    scientist,<br \/>\n     representing  the\t Indian\t Science<br \/>\n     Congress\tAssociation,\tto    be<br \/>\n     nominated\t  by\t the\t Central<br \/>\n     Government;\n<\/p><\/blockquote>\n<blockquote><p>     (f)  Four\trepresentatives\t of  the<br \/>\n     medical   faculties    of\t  Indian<br \/>\n     Universities to be nominated by the<br \/>\n     Central Government\t in  the  manner<br \/>\n     prescribed by rules; and\n<\/p><\/blockquote>\n<blockquote><p>     (g) Three\tmembers of Parliament of<br \/>\n     whom  two\tshall  be  elected  from<br \/>\n     among themselves  by the members of<br \/>\n     the House\tof the\tPeople\tand  one<br \/>\n     from  among   themselves\tby   the<br \/>\n     members of the Council of States.<\/p><\/blockquote>\n<p>     Each interest  mentioned in  Section 4  appears  to  be<br \/>\ndistinct and  separate interest to represent the AIIMS as an<br \/>\ninstitute  body.   Clause  (e),\t if  read  as  a  whole,  is<br \/>\nsusceptible of two interpretations. One interpretation which<br \/>\nfound favour  with the\ttwo learned  Judges of the  Division<br \/>\nBench is  that all  the five  persons &#8211;\t one non medical and<br \/>\nfour medical  scientists would be nominated to represent the<br \/>\nIndian\t Science    Congress\tAssociation.\tThe    other<br \/>\ninterpretation is that one among the five persons would be a<br \/>\nnon-medical  scientist\t representing  the   Indian  Science<br \/>\nCongress Association  and other\t four would  be\t other\tthan<br \/>\nscientists. If\tthe working  of the Act from 1956 is kept in<br \/>\nview,  it   would  appear   that  they\t intended  to\tgive<br \/>\nrepresentation to  four persons\t other than  the  scientists<br \/>\nneither\t medical  nor  non-medical.  But  in  actuality\t the<br \/>\nCentral Government  appears  to\t have  intended\t to  have  a<br \/>\nrepresentation\tfrom  the  Ministry  of\t Health\t and  Family<br \/>\nWelfare\t and  other  official  persons\twho  are  intimately<br \/>\nconnected or associated with the working of the AIIMS. It is<br \/>\nneedless to  mention  that  AIIMS  is  one  of\tthe  premier<br \/>\ninstitutions in\t the country  which maintains high standards<br \/>\nrequired  to   be  maintained\tfor  catering\tthe  medical<br \/>\nfacilities to  all  teaming  patients,\tfrom  all  over\t the<br \/>\ncountry, who  seek the\texpert treatment from doctors having<br \/>\nprofound  and\tspecialized  knowledge\t in  the  respective<br \/>\nfaculties  and\t specialities.\tIn  the\t management  of\t the<br \/>\nsupremebody, the  Government also seem to evince interest in<br \/>\nits proper,  efficient, effective  and\torderly\t management.<br \/>\nObvious, therefore,  the Government  exercising the power on<br \/>\nMarch 9,  1994 nominated the appellant, who was then holding<br \/>\nthe port-folio as Minister of Health and Family Welfare, the<br \/>\nsecond member  Mr. M.S.\t Dayal holding\tthe office,  at that<br \/>\ntime as\t the Secretary, Department of Health, Professor J.S.<br \/>\nBajaj, Member, Planning Commission and Professor P. Chandra,<br \/>\nFormer Dean, AIIMS.\n<\/p>\n<p>     It is  true, as  contended by Sri G. Ramaswamy, learned<br \/>\nsenior counsel,\t that the word &#8216;person&#8217; has to be understood<br \/>\nin the\tcontext in  which the  language was  couched and the<br \/>\nperson mentioned  in clause  (e) would\tbe other  than those<br \/>\nscientists either medical or nonmedical. It is also true, as<br \/>\ncontended by  Shri D.D. Thakur, learned senior counsel, that<br \/>\nwhen Section  6 contemplates  ex-officio members, their term<br \/>\nis coterminous\twith their cessation of office, Section 4(e)<br \/>\ndoes not  seemingly intend to refer to nomination associated<br \/>\nwith the  office, but  to the  individual members other than<br \/>\nnon medical  scientists representing Indian Science Congress<br \/>\nAssociation.   But    on   a\tharmonious   and    conjoint<br \/>\ninterpretation, we  are of  the opinion that the Government,<br \/>\nwhile enacting the Act, appears to have intended to preserve<br \/>\nthe autonomy  of the  AIIMS, and  also to  have a say in its<br \/>\nmanagement.  Under   those  circumstances,   the  Government<br \/>\nappears to  have nominated the Minister of Health and Family<br \/>\nWelfare\t and  the  Secretary  of  Department  of  Health  as<br \/>\nChairman and  member respectively  so that  in the  ultimate<br \/>\nmanagement of  the supreme  body constituted  under the Act,<br \/>\nthe Government\talso  will  protect  the  interests  of\t the<br \/>\ninstitution. Otherwise, it would  appear that the Government<br \/>\ndoes not  seem to  have any say or control in the management<br \/>\nof the\tAIIMS. Considered from this pragmatic background and<br \/>\nfrom the  point of view of the importance of the institution<br \/>\nand public interest, we are of that considered view that the<br \/>\nCentral Government is justified to nominate four<br \/>\npersons, other then scientists and the fifth being the<br \/>\nnon-medical scientist representing the Indian Science<br \/>\nCongress Association. However four members may be<br \/>\nintegrally connected with the management and associated<br \/>\nalso with the working of the AIIMS. If this<br \/>\ninterpretation is given, we are of the view that it<br \/>\nwould subserve the greater public interest in the<br \/>\nproper, effective, efficient and orderly management of<br \/>\nAIIMS and the purpose of establishing the institution<br \/>\nto maintain high standards, discipline and order in its<br \/>\nmanagement would be best subserved. However, there<br \/>\nshould be no undue interference by the Government of<br \/>\nIndia in the autonomous management of the AIIMS and it<br \/>\nshould not  be\ttreated\t as  any  other\t Department  of\t the<br \/>\nGovernment, since  the object  of  the\tAct  is\t to  improve<br \/>\nexcellence and\thigh standards\tin all\tfaculties of medical<br \/>\nspecialities and of treatment.\n<\/p>\n<p>     Accordingly, we  hold that\t the appellant was nominated<br \/>\nby virtue of his office as the Minister of Health and Family<br \/>\nWelfare and  he would be entitled to continue in that office<br \/>\nas long\t as he held that office. Thereafter, he ceases to be<br \/>\na member  of the  supreme body\tand consequently  to be\t the<br \/>\nChairman of  the body  as nominated by the Government in the<br \/>\nsame order  dated March\t 9, 1994. In his place the incumbent<br \/>\nsucceeding to  the office  of Minister\tof Health and Family<br \/>\nWelfare would  be entitled  to be  nominated by\t the Central<br \/>\nGovernment and\the would  hold the  office for\tthe  residue<br \/>\nperiod. This  will be  consistent with\tsub-section  (2)  of<br \/>\nSection 6 also.\n<\/p>\n<p>     Accordingly, we  hold that\t the Central  Government  is<br \/>\nempowered to  nominate five  persons under  Section 4(e), as<br \/>\nindicated above\t and the  persons would\t be members  of\t the<br \/>\nsupreme\t body\tof  the\t AIIMS.\t Consequently,\tthe  Central<br \/>\nGovernment is  also empowered  to nominate  the Minister  as<br \/>\nChairman as was done earlier.\n<\/p>\n<p>     The appeal is accordingly disposed of. Whatever actions<br \/>\nhave been  taken pursuant  to the  nomination are  saved  by<br \/>\nSection 22  of the  Act. If  any other\tlegal issue relating<br \/>\ninterse claims of competing candidates is involved, it would<br \/>\nbe open\t to the\t aggrieved persons  to agitate\ttheir rights<br \/>\naccording to law.
