There is communication dated  25.2.2011 from the<br \/>\nMedical Officer, Vadodara Central Jail, Vadodara to the<br \/>\nSuperintendent, Vadodara Central Jail, Vadodara.  In this<br \/>\ncommunication at item No.4, it is mentioned that &#8216;For Thyroid<br \/>\nFunction Test he was referred to Civil Hospital Ahmedabad on<br \/>\nDt.14-10-2010&#8217;.  Item No.5 says that &#8216;H.O.D. Of Biochemistry sent<br \/>\nback the patient with a note stating &#8216;Thyroid Function Test recently<br \/>\nnot been done in Hi-Tech Laboratory&#8217;.\n<\/p>\n<p>\t\tThere<br \/>\nis medical paper attached to the application wherein this item No.5<br \/>\nis found.  It is under the signature of Professor and Head of the<br \/>\nDepartment of Biochemistry, B.J.Medical College, Ahmedabad.\n<\/p>\n<p>\t\tThe<br \/>\nCourt is at pains to observe that after 14.10.2010 when the convict<br \/>\nwas referred for &#8216;Thyroid Function Test&#8217; which could not be<br \/>\nmaterialized on account of some difficulties with the Hi-Tech<br \/>\nLaboratory, nobody bothered to re-refer the convict for the said test<br \/>\nthough almost five months are over by today.\n<\/p>\n<p>\t\tRegistry<br \/>\nis directed to send a copy of this order to the I.G.Prisons, who, in<br \/>\nturn, is expected to issue necessary circular or instructions to all<br \/>\nconcerned that when it is a matter of medical treatment, a person<br \/>\nconcerned must have personal touch in the matter. This absence of<br \/>\n&#8216;personal touch&#8217; is clearly borne out from the papers of the present<br \/>\ncase wherein though the patient was referred for &#8216;Thyroid Function<br \/>\nTest&#8217; on 14.10.2010 which could not be materialized, nobody bothered<br \/>\nfor subsequent five months to re-refer the convict for the said test.<br \/>\n I.G.Prisons to ensure that such situation is not repeated in future.\n<\/p>\n<p>\t\tFrom<br \/>\nthe jail remarks, it is clear that the convict prisoner has enjoyed<br \/>\nthree temporary bails and one furlough.  Lastly, he was out on<br \/>\ntemporary bail for seven days from 15.1.2011 to 21.1.2011 for his own<br \/>\nengagement.\n<\/p>\n<p>\t\tRule.\n<\/p>\n<p> Learned APP Mr.Raval waives service of notice of rule on behalf of<br \/>\nthe respondent State.\n<\/p>\n<p>\t\tTaking<br \/>\ninto consideration the contents of the application, the application<br \/>\nis partly allowed.  The convict prisoner is ordered to be released on<br \/>\ntemporary bail initially for a period of 30 days from the date of his<br \/>\nactual release on his executing a personal bond of Rs.5000\/- (Rupees<br \/>\nfive thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the Jail authorities.\n<\/p>\n<p>\t\tOn<br \/>\nhis production of convincing material about the treatment and<br \/>\nprogress therein, it will be open for the convict prisoner to renew<br \/>\nhis request for extension of temporary bail period.\n<\/p>\n<p>\t\tThe<br \/>\napplicant shall surrender himself to the Jail authorities on expiry<br \/>\nof the above temporary bail period.
