Justice K.HEMA\n\n Dated :16\/02\/2009\n\n O R D E R\n                              K.HEMA, J.\n\n               -----------------------------------------\n                        B.A.No. 7423 of 2008\n               -----------------------------------------\n\n              Dated this the 16th January, 2009\n\n                            O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 394, 294, 427<\/p>\n<p>and 34 of the Indian Penal Code. According to prosecution,<\/p>\n<p>petitioners, who are employees of ICICI Bank (Collection<\/p>\n<p>Manager,     Officer-Collection      and      Collection  Executive<\/p>\n<p>respectively), committed various offences in respect of a<\/p>\n<p>vehicle on default of payment of instalment in accordance with<\/p>\n<p>the hire purchase agreement.\n<\/p>\n<p>      3.  Learned counsel        for petitioners submitted that<\/p>\n<p>anticipating repossession of the vehicle by the bank authorities,<\/p>\n<p>de facto complainant abandoned the vehicle and the vehicle<\/p>\n<p>was seen abandoned and it was taken away by the police.<\/p>\n<p>Petitioners have not committed any offence.. During the<\/p>\n<p>pendency of this petition, when these facts were brought to the<\/p>\n<p>notice of the court, first accused was directed to report before<\/p>\n<p>the investigating officer on 12.2.2009 and he was questioned<\/p>\n<p>by the investigating officer.\n<\/p>\n<p><span class=\"hidden_text\">  BA.7423\/08                      2<\/span><\/p>\n<p>     4. Learned Public Prosecutor, on instructions, submitted<\/p>\n<p>that he has no objection in granting bail, but petitioners may be<\/p>\n<p>directed to surrender before the investigating officer and co-<\/p>\n<p>operate with the investigation as and when required.<\/p>\n<p>     On hearing both sides, I find that anticipatory bail can be<\/p>\n<p>granted to petitioners and the following order is passed:<\/p>\n<blockquote><p>            Petitioners   shall    surrender   before     the<\/p>\n<p>      Magistrate Court concerned within seven days from<\/p>\n<p>      today and he shall be released on bail on their<\/p>\n<p>      executing bond for Rs.25,000\/- each with two solvent<\/p>\n<p>      sureties each for the like sum to the satisfaction of<\/p>\n<p>      the Magistrate Court concerned, on the following<\/p>\n<p>      conditions:\n<\/p><\/blockquote>\n<blockquote><p>      (i)   Petitioners shall report before the investigating<\/p>\n<p>            officer as and when directed and co-operate<\/p>\n<p>            with the investigation.\n<\/p><\/blockquote>\n<blockquote><p>      (ii).
