GIRI, J.\n                   -------------------------------\n                     CRA.NO. 691 of 2001\n                  ---------------------------------\n         Dated this the 29th        day of August, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>     The complainant in CC.No.1200\/95 on the files of the JFCM<\/p>\n<p>Court-II Ernakulam is the appellant herein.       The calendar case<\/p>\n<p>arose out of a complaint filed by the appellant herein alleging<\/p>\n<p>that the accused has committed an offence under section 138 of<\/p>\n<p>the Negotiable Instruments Act.         At the conclusion of the<\/p>\n<p>evidence the accused was questioned under section 313 of the<\/p>\n<p>Cr.P.C. The court below went on to find that the complainant<\/p>\n<p>had no ample evidence to prove the guilt of the accused beyond<\/p>\n<p>reasonable doubt and accordingly acquitted the accused under<\/p>\n<p>section 255(1) of the Cr.P.C.     The same has been challenged in<\/p>\n<p>this appeal.\n<\/p>\n<p>     2. The case of the complainant was that the accused had<\/p>\n<p>issued Ext.P1 cheque drawn on the Kaippamangalam branch of<\/p>\n<p>the Canara Bank on 15.11.1994 in favour of the complainant<\/p>\n<p>towards the consideration for the construction work of the<\/p>\n<p>accused.    Later the cheque on presentation was dishonoured for<\/p>\n<p><span class=\"hidden_text\">CRA.691 \/2001               2<\/span><\/p>\n<p>want of sufficient funds. Though notice was issued, payment was<\/p>\n<p>not made and thereafter the complaint was lodged. The power of<\/p>\n<p>attorney holder of the     complainant was examined as PW1.<\/p>\n<p>Exts.D1 to D14 were marked through PW1 himself as defence<\/p>\n<p>evidence. The stand taken by the accused was that Ext.D1<\/p>\n<p>agreement was executed between the complainant company and<\/p>\n<p>the accused for the construction of a two storied residential<\/p>\n<p>building for the benefit of the accused.         The agreement<\/p>\n<p>contemplated staggered payment of a total amount of<\/p>\n<p>Rs.4,20,000\/-. The payment was to be made at different stages<\/p>\n<p>of the construction. It so happened the construction was not<\/p>\n<p>carried ourt in accordance with the plan supplied.  In fact there<\/p>\n<p>was diminution in the total plinth area contemplated in the plan.<\/p>\n<p>Ext.D3 to D14         receipts will show that an amount of<\/p>\n<p>Rs.1,85,000\/- was paid by the accused to the         complainant<\/p>\n<p>company.     Specific suggestion in this regard made in the cross<\/p>\n<p>examination of PW1 elicited the above mentioned facts. The<\/p>\n<p>specific case of the accused was that Ext.P1 cheque was issued<\/p>\n<p>only as a security and therefore it was not supported by<\/p>\n<p>consideration.\n<\/p>\n<p><span class=\"hidden_text\">CRA.691 \/2001                3<\/span><\/p>\n<p>     3.    Having gone through the evidence in the case, one<\/p>\n<p>aspect which is to be noted straight away is that the complaint<\/p>\n<p>and Ext.P3 notice are silent regarding the construction agreement<\/p>\n<p>and payment of amounts by the accused to the construction<\/p>\n<p>company in instalments. Apparently the complainant only put<\/p>\n<p>forward a case that a cheque was issued towards cost of the<\/p>\n<p>construction work of the accused and that the cheque was later<\/p>\n<p>dishonoured for want of sufficient fund. Sufficient evidence has<\/p>\n<p>been adduced by the accused to rebut the statutory presumption<\/p>\n<p>under section 139 of the Negotiable Instruments Act and it<\/p>\n<p>cannot be said that the court below committed an error in holding<\/p>\n<p>that Ext.P1 cheque was not supported by consideration.<\/p>\n<p>     For all these reasons, I do not find any ground to interfere<\/p>\n<p>with the order of acquittal passed by the court below. The appeal<\/p>\n<p>is bereft of merit. It is accordingly dismissed.<\/p>\n<p>                                           V.
