Union of India and others, decided on 3.7.2009.<\/p>\n<p>            Counsel for the appellants states that she has no objection, if<\/p>\n<p>the appeal is taken up for hearing.\n<\/p>\n<p>            The application is allowed and the appeal is taken up for<\/p>\n<p>hearing.\n<\/p>\n<p>RSA No.4896 of 2002<\/p>\n<p>            The Union of India challenges the judgement and decree dated<\/p>\n<p>8.8.2002, passed by the Additional District Judge, Gurdaspur, accepting the<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                                    2<\/span><\/p>\n<p>appeal filed by the respondent, setting aside the judgement and decree<\/p>\n<p>passed by the Civil Judge (Junior Division), Gurdaspur and as a<\/p>\n<p>consequence, decreeing the suit filed by the respondent.<\/p>\n<p>             The plaintiff-respondent filed a suit for declaration that he is<\/p>\n<p>entitled to disability pension from the date of his discharge from military<\/p>\n<p>service i.e. 22.10.1966. In response, the Union of India, asserted that as per<\/p>\n<p>the opinion of the discharge medical board, the disability i.e.<\/p>\n<p>&#8220;HYSTERICAL REACTION to the extent of 30%&#8221; is a constitutional<\/p>\n<p>disorder and is not attributable to military service.<\/p>\n<p>             After considering the pleadings, the evidence adduced and the<\/p>\n<p>arguments addressed, the trial court dismissed the suit by holding that as the<\/p>\n<p>medical board has recorded an opinion that the disease is a constitutional<\/p>\n<p>disorder, not attributable to military service,    the respondent cannot be<\/p>\n<p>granted any relief.\n<\/p>\n<p>             Aggrieved by the aforementioned judgement and decree, the<\/p>\n<p>respondent filed an appeal. Vide judgement and decree dated 8.8.2002, the<\/p>\n<p>learned Additional District Judge, Gurdaspur, accepted the appeal, set aside<\/p>\n<p>the judgement and decree passed by the trial court and decreed the suit. The<\/p>\n<p>first appellate court held that as the appellants have failed to prove that the<\/p>\n<p>respondent was suffering from this disease on the date of his enrolement in<\/p>\n<p>the army, he is entitled to disability pension.\n<\/p>\n<p>             Counsel for the appellants submits that the opinion of a<\/p>\n<p>discharge medical board is final and, therefore, the first appellate court<\/p>\n<p>could not have accepted the appeal. Counsel for the respondent, however,<\/p>\n<p>submits that&#8221;HYSTERICAL REACTION&#8221; is not a constitutional disease<\/p>\n<p>and may develop during military service. It is further argued that a Division<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                                    3<\/span><\/p>\n<p>Bench of this Court has held in LPA No. 174 of 2008 Bakshish Singh Vs.<\/p>\n<p>Union of India and others, that if the opinion of a discharge medical board<\/p>\n<p>is not supported by reasons or documentary proof, it cannot be treated as<\/p>\n<p>conclusive. Counsel for the appellants does not deny the above judgement<\/p>\n<p>but states that as &#8220;HYSTERICAL REACTION&#8221; is a constitutional disease,<\/p>\n<p>the respondent is not entitled to any relief.\n<\/p>\n<p>             I have heard counsel for the parties, perused the impugned<\/p>\n<p>judgement and decree. The substantial question of law that arises for<\/p>\n<p>adjudication is &#8220;-\n<\/p>\n<blockquote><p>                     &#8220;Whether     the respondent\/plaintiff is entitled to the<\/p>\n<p>                     disability pension under Regulation 173 of Army<\/p>\n<p>                     Regulation 1961 where the expert opinion in the form of<\/p>\n<p>                     medical board proceedings held that the disability is into<\/p>\n<p>                     attributable to service and has not been aggravated and is<\/p>\n<p>                     not connected with service and thus is constitutional in<\/p>\n<p>                     nature ?<\/p>\n<p>             The above question has been answered by a Division Bench of<\/p>\n<p>this Court in LPA No.174 of 2008 <a href=\"\/doc\/631058\/\">Bakshish Singh V. Union of India and<\/p>\n<p>others<\/a> by holding as follows :-\n<\/p>\n<blockquote><p>                     &#8220;Though medical opinion relied upon on behalf of the<\/p>\n<p>                     respondent is to the effect that the disease was not<\/p>\n<p>                     attributable to Army service and the medical opinion has<\/p>\n<p>                     to be given due weight, as held by the Hon&#8217;ble Supreme<\/p>\n<p>                     Court in <a href=\"\/doc\/1462599\/\">Union of India and others V. Keshar Singh<\/a><\/p>\n<p>                     (supra) there has to be some       discernible   basis of<\/p>\n<p>                     medical opinion. Mere mention of words `not attributable<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                               4<\/span><\/p>\n<p>               to Army service&#8217; without giving any reasons,cannot be<\/p>\n<p>               accepted as conclusive. This aspect has been considered<\/p>\n<p>               in the judgement of this court dated 1.7.2009 in Union of<\/p>\n<p>               India &amp; another V. No.727213 Ex.-Airman B.S. Rana.<\/p>\n<p>               Therein, after referring to various judgements of the<\/p>\n<p>               Hon&#8217;ble Supreme Court, it was held as under :-<\/p>\n<\/blockquote>\n<blockquote><p>               8.     In a recent judgement in <a href=\"\/doc\/33618262\/\">Union of India and others<\/p>\n<p>               V. Ex.Sepoy Ranjit Singh, PA No.547 of<\/a> 2001, decided<\/p>\n<p>               on 11.2.2009, the matter was considered by this Court<\/p>\n<p>               and it was held that if the circumstances give rise to an<\/p>\n<p>               inference that disease was attributable to the Air Force<\/p>\n<p>               Service, negative opinion of the Medical Board given<\/p>\n<p>               without any basis could not be teated as conclusive. After<\/p>\n<p>               referring to judgements in Union of India and another V.<\/p>\n<p>               Baljit Singh, 1996(2) SCC 316, <a href=\"\/doc\/508656\/\">Controller of Defence<\/p>\n<p>               Accounts (Pension) and others V. S.Balachandran Nair,<\/p>\n<p>               AIR<\/a> 2005 SC 4391, Navin Chandra V. Union of India<\/p>\n<p>               and others, 2006(4) SCT 626 (Delhi), Union of India and<\/p>\n<p>               others V. Hemant Kumar, 2009(1) RSJ 196 <a href=\"\/doc\/527547\/\">(MP) and<\/p>\n<p>               Joginder Singh V. Union of India and others<\/a>, CWP<\/p>\n<p>               No.7323 of 2007, decided by this court on 4.12.2007, it<\/p>\n<p>               was observed :-\n<\/p><\/blockquote>\n<blockquote><p>                      &#8220;14. We are of the view that the judgements of the<\/p>\n<p>                      Hon&#8217;ble Supreme Court in Baljit Singh&#8217;s case and<\/p>\n<p>                      S.Balacnandra     Nair&#8217;s     case    (supra)    are<\/p>\n<p>                      distinguishable on facts. In the present case it has<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                                  5<\/span><\/p>\n<p>                      been admitted in the written statement (that) there<\/p>\n<p>                      was an episode of Generalised Tonic Clonic<\/p>\n<p>                      Seizure on 11.10.1998 when the petitioner was in<\/p>\n<p>                      service and he was given treatment which<\/p>\n<p>                      continued thereafter. In the opinion of the Medical<\/p>\n<p>                      Board Annexure RA, there is no reason given as to<\/p>\n<p>                      how the said illness did not relate to the disability<\/p>\n<p>                      in question. The disability is clearly relatable to the<\/p>\n<p>                      episode which is duly admitted in the written<\/p>\n<p>                      statement. It may have been a different matter if<\/p>\n<p>                      such an episode had not happened. The opinion of<\/p>\n<p>                      the medical board in the present case was thus<\/p>\n<p>                      arbitrary in ignoring the admitted incident.<\/p>\n<\/blockquote>\n<blockquote><p>                      15.   In Naveen Chander (supra), it was held that<\/p>\n<p>                      the opinion of Medical Board must be self<\/p>\n<p>                      contained and well reasoned and supported by<\/p>\n<p>                      documentary proof and therefore, the opinion that<\/p>\n<p>                      the disease was not attributable to the military<\/p>\n<p>                      service was without any basis. Moreover, para 14<\/p>\n<p>                      of 1982 Rules provides that if a person is fit at the<\/p>\n<p>                      time of entry into service, there will be no<\/p>\n<p>                      presumption that the disease is due to military<\/p>\n<p>                      service though on facts it could be established that<\/p>\n<p>                      the disability existed prior to entry into service and<\/p>\n<p>                      the mere fact that such disease was not detected at<\/p>\n<p>                      the time of entry into service will not be<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                                  6<\/span><\/p>\n<p>                        conclusive. Similar view has been taken by this<\/p>\n<p>                        court in Joginder Singh and Ex.Sepoy Bhola Ram<\/p>\n<p>                        (supra) and the Madhya Pradesh High Court in<\/p>\n<p>                        Hemant Kumar (supra)<\/p>\n<\/blockquote>\n<blockquote><p>                        16.   In view of the above, no fault can be found<\/p>\n<p>                        with the finding recorded by the learned Single<\/p>\n<p>                        Judge that the disability of the petitioner was<\/p>\n<p>                        attributable to the military service and he was<\/p>\n<p>                        entitled to disability pension from the date of his<\/p>\n<p>                        discharge from the military service.&#8221;<\/p>\n<\/blockquote>\n<\/blockquote>\n<blockquote><p>                  We, thus,hold that in absence of any reason whatsoever<\/p>\n<p>                  for the opinion that the disability was not attributable to<\/p>\n<p>                  Army service, medical opinion cannot be treated as<\/p>\n<p>                  conclusive. The judgement in <a href=\"\/doc\/1462599\/\">Union of India &amp; Ors. V.<\/p>\n<p>                  Keshar Singh<\/a> (supra) is distinguishable on facts. We<\/p>\n<p>                  affirm the finding recorded by the learned Single Judge<\/p>\n<p>                  that the disease in this case was attributable to Army<\/p>\n<p>                  service.&#8221;<\/p><\/blockquote>\n<p>            It is, therefore, apparent that in the absence of any reasons or<\/p>\n<p>material to support its conclusion, the opinion recorded by a Medical Board<\/p>\n<p>cannot be held to be conclusive. The question of law framed in the present<\/p>\n<p>appeal is squarely covered by the aforementioned judgement and is<\/p>\n<p>answered accordingly.\n<\/p>\n<p>            It would be necessary to mention that the appellant in the case<\/p>\n<p>before the Division Bench and the respondent in the present case both<br \/>\n<span class=\"hidden_text\"> RSA No.4896 of 2002                                                    7<\/span><\/p>\n<p>suffer from &#8220;HYSTERICAL REACTION to the extent of 30%&#8221;. The<\/p>\n<p>respondent was admittedly hale and hearty when he entered military service.<\/p>\n<p>During his service, he developed HYSTERICAL REACTION and was<\/p>\n<p>eventually discharged with 30% disability. The respondent was refused a<\/p>\n<p>disability pension on the opinion of the medical board that this disease is<\/p>\n<p>constitutional and not attributable to military service. The medical opinion<\/p>\n<p>is not supported by any reasons or material and is, therefore, not conclusive<\/p>\n<p>of the opinion that the disability is not attributable to military service. The<\/p>\n<p>Division Bench discarded a similar opinion allowed the appeal and granted<\/p>\n<p>disability pension to the appellant therein by holding that the opinion of the<\/p>\n<p>medical board is not binding.
