SHAH\n\t\t\n\t\n\n \n\nDate\n: 12\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner &#8211; husband has prayed to quash and set aside the<br \/>\nimpugned order dated 11\/03\/2011 passed by learned Principal Judge,<br \/>\nFamily Court No.1, Ahmedabad passed below Exh.19 in Criminal<br \/>\nMisc.Application No.1346\/2007, by which, learned Judge has directed<br \/>\nthe petitioner to pay a sum of Rs.2,000\/- per month to respondent<br \/>\nNo.1 &#8211; wife towards maintenance.\n<\/p>\n<p>2.\t\tMr.Pathak,<br \/>\nlearned advocate appearing on behalf of the petitioner has vehemently<br \/>\nsubmitted that there is a marriage span of four months only and the<br \/>\npetitioner is required to look after his old aged parents and,<br \/>\ntherefore, learned Family Court has materially erred in awarding<br \/>\nRs.2,000\/- per month to respondent No.1- wife towards maintenance.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard learned advocate appearing on behalf of the petitioner and<br \/>\nconsidering the impugned order in awarding Rs.2,000\/- per month to<br \/>\nrespondent No.1 &#8211; wife towards maintenance and in the facts and<br \/>\ncircumstances of the case, it cannot be said that the learned Family<br \/>\nCourt has committed any error and\/or illegality in awarding the<br \/>\namount, which is too excessive and  which is required to be<br \/>\ninterfered with by this Court in exercise of power under Article 226<br \/>\nof the Constitution of India.\n<\/p>\n<p>4.\t\tNow<br \/>\nso far as contention on behalf of the petitioner that the marriage<br \/>\nspan is four months only is concerned, the same is insignificant<br \/>\nwhile considering the application for maintenance under Section 125<br \/>\nof the Code of Criminal Procedure. In these hard days and price rise,<br \/>\netc. and considering the fact that the petitioner is rickshaw driver<br \/>\nof the Transport Vehicle in Industrial area, it cannot be said that<br \/>\nthe learned Family Court has committed any error in awarding<br \/>\nRs.2,000\/- per month towards maintenance to the respondent No.1-<br \/>\nwife.
