Whether the judgment should be reported in the Digest?\n\n\nHEMANT GUPTA, J.\n<\/pre>\n<p>            The petitioners    have invoked the writ jurisdiction of<\/p>\n<p>this Court for issuance of a writ      of mandamus        directing the<\/p>\n<p>respondents to     frame a    rational policy   keeping in view    the<\/p>\n<p>periodic pronouncements and law laid down by the Hon&#8217;ble<\/p>\n<p>Supreme Court.\n<\/p>\n<p>            It is the case of the petitioner that in pursuance of the<\/p>\n<p>advertisement for the post of pump operator and sewerage man<\/p>\n<p>issued by Market Committee Khamano, the petitioners were<\/p>\n<p>appointed on adhoc basis        in December, 1986.        Though the<\/p>\n<p>petitioners were   appointed on adhoc basis, but still respondent<\/p>\n<p>No. 4 i.e. the Secretary, Market Committee, Khamano warned<\/p>\n<p>the petitioner to accept the salary on daily wage basis and in case<\/p>\n<p>they do not accept such salary, their services will be terminated.<\/p>\n<p>            The petitioners claim that since they are working on<\/p>\n<p>adhoc basis, the respondents are bound to regularise their<br \/>\n CWP No.8504 of 1989                               (2)<\/p>\n<p>services. Reliance was placed upon the judgment in <a href=\"\/doc\/783800\/\">Piara Singh<\/p>\n<p>v. State of Haryana,<\/a> 1989(1) PLR 396.\n<\/p>\n<p>             The judgment in Piara Singh case (supra) was set<\/p>\n<p>aside by the Hon&#8217;ble Supreme Court in         State of Haryana and<\/p>\n<p>others, etc. etc. v. Piara Singh and others etc. etc., AIR 1992<\/p>\n<p>Supreme Court 2130. Still later in Secretary State of Karnataka<\/p>\n<p>and others v. Uma Devi and others, 2006(4) SCC page 1, the<\/p>\n<p>Hon&#8217;ble Supreme Court has held that            the public posts are<\/p>\n<p>required to be filled up by          the public advertisements and<\/p>\n<p>providing an opportunity to all eligible candidates to apply and<\/p>\n<p>compete for the post(s).\n<\/p>\n<p>             As per the allegations of the petitioners themselves,<\/p>\n<p>they were appointed on adhoc basis. The process of selection<\/p>\n<p>on regular basis is required to be undertaken by the Market<\/p>\n<p>Committee,    which        process    alone   would     be   legal   and<\/p>\n<p>constitutional.\n<\/p>\n<p>             In view of the above, the claim of the petitioners for<\/p>\n<p>regularisation of their services is wholly unjustified and therefore,<\/p>\n<p>the same is not sustainable.\n<\/p>\n<p>             Consequently, I not find any merit in the writ petition.<\/p>\n<p>Hence, the same is dismissed.\n<\/p>\n<\/p>\n<p>                                       (HEMANT GUPTA)<br \/>\n                                           JUDGE<br \/>\n09-07-2008<br \/>\n  ds\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Bant Singh And Another vs Secretary Punjab Mandi Board And &#8230;
